Humphrey E. 11101 Empire Avenue Spokane, Washington 99220 Dear Ms. Humphrey: Thank you for your letter dated September 18, 1987,'in which you call our atten- tion to a "conflict of septic tank location" at E. 11103 Empire Avenue. We have researched our file records; and conducted a site visit this date for the purpose of investigating the allegation. Please be advised that we have determined the neighbor's garage -structure to be partially over the location of the septic tank system serving the residence in question. 0ur records reflect a telephone contact with a representative of the Spokane County Department of Building and Safety on or about December 27, 1985. There had, apparently, been a similar allegation made to that department at that time. A representative of this agency was dispatched to the site on December 31, 1985 to investigate the alleged problem. That representative reported back that he did not observe a conflict (setback distances) between the newly constructed garage and the existing on -site sewage system. This finding was forwarded to the Department of Building and Safety...which subsequently issued a permit to the pro- perty owner for the structure. Our visit to the site this date revealed that a misinterpretation of the file record had been made in 1985 in that the residential structure had been added to sometime after our original sewage record was filed. Therefore, the "house" corner, from which the inspector originally measured to the septic tank system (in 1985) was not the corner from which the original in- spector had measured in 1955. The structure appears to be a "free-standing" frame with a solid roof...utilized as an automobile shelter. There is no permanent footings and foundation for the structure; and thus, we determine it to be of a temporary nature. Even though the structure does appear to conflict with the setback requirements of our regula- tions for sewage disposal systems, we feel it is not creating a public health hazard at this time. To remove the structure from the area of the sewage system, or to relocate the sewage disposal system away from the structure would be un- reasonable and unnecessary at this time. We will be contacting the owner, how- ever, for the purpose of opposing any future enclosing effort for the structure; and indicating we will require relocation of the sewage system at any time in the future the existing system fails to operate correctly.
