My clients applied for a permit regarding several additions to their home in 1981. Permit #81A-8364 clearly states that the permit included the addition of the family room. Upon completion of the family room in 1985, Mr. Johnson called the building department for an inspection of the final addition under the 1981 permit. Mr. Johnson had no response from the building department. Clearly, the inspector in 1984 incorrectly closed the permit since the family room had not been completed. Mr. Johnson has tried for several months to obtain a variance for the family room addition. According to the Spokane Municipal Code, 11.19.520, Yards Assessory Uses, assessory structures for R-1 zones must set back at least "sixty feet from the front property line." The addition to the Johnson's residence in question does meet these set back requirements. There is a twenty five foot radius on the side corner lot with respect to the addition in question. Bill Moser stated that the radius was adequate to permit the administra- tive variance, however, Jeff Forry has stated to my clients that they will never get a variance on their property. In fact they have received a different answer from every person in the building department that they have contacted regarding this family room addition. Eaves, cornices, belt courses and similar ornamentations may extend over a side yard for a distance of not more than two (2) feet. 2. Platforms, terraces and steps, not over forty-two (42) inches in height may extend into a side yard. 3. Accessory buildings when located not Tess than seventy (70) feet from the front property line or when the accessory building is not more than thirty-five (35) feet from the rear lot line may occupy the side yard along an inside lot- line. 4. Fireplaces may extend into a side yard a distance of not more than eighteen (18) inches. 4.17.030 Rear Yard a Where any specified rear yard is required, no building shall be hereafter erected or altered so that any portion thereof may be nearer to the rear lot line than the distance indicated by the depth of the required rear yard. b. In the Agricultural Suburban or Two Family Residential Zone, not more than forty (40) percent of the rear yard may be occupied by accessory or other buildings. c. Exceptions: Eaves, cornices, steps, platforms, and open porches may extend into the rear yard. Private garages attached to a dwelling may extend into the rear yard. d. No rear yard is required for accessory buildings. e. If on a corner lot a residence maintains the required front yard setback from both the front and flanking streets, the rear yard shall be that area included within a twenty- five (25) foot radius measured from the inside lot corner. 4,17,035 Canopies a Any service station canopy may extend into the front or flanking street "yard" areas provided that the support columns are located in the pump islands and further • provided that no canopy shall extend closer than five (5) feet to any property line. b. Drive-in restaurant canopies for customer off-street parking service constructed parallel to a street may extend into the front yard setback area fifteen (15) feet, but no closer than twenty (20) feet from the front property line. Restaurant canopies constructed parallel to a street may come no closer than twenty (20) feet from the flanking street property line. Whenever a restaurant canopy for the off-street customer parking is constructed perpendicularly to a street, the canopy may extend to within five (5) feet of the property line.
