As we discussed, and after a through review of the information you
submitted, a new permit and subsequent setback variance will not be
required for your family room based on the following:
1. A permit, #S1A-8364 was issued in August of 1991 for "2nd
floor addition (Bedroom, Bath, Family Room)." The 639 square
feet as indicated on the permit is consistent with 2nd floor
area indicated in Assessor's record, the square footage of
the a main floor family room was not included on the permit.
2. Based on conversations with you and correspondence from your
attorney (attachment #1) it was your belief that permit
#81A-8364 included a main floor family room addition.
3. Inspection records indicate inspections during the time frame
the owner contends addition was constructed. (inspector could
not specifically remember job but after reviewing notes on the
inspection records, he felt that the comments were consistent
with a main floor addition as well as the 2nd floor)
4. Assessor's record (attachment #2) indicates addition of main
floor family room was done during the open period of the
permit.

5. An interpretation can be drawn that permit #81A-8364 was valid
for the addition and should include the main floor family room
and accordingly section 4.17.030 of the Zoning Ordinance
(attachment #3) in effect at that time should be used to
alidate the 7' setback to the west of the property.
