Greetings; After further review, Mike thinks this should have gone to you. He still is having trouble with this e-mail thing. I put the file back on your desk. I think we need to get together with the owner again and get him involved with obtaining a Building Permit for a Safety Inspection to be used to identify any unsafe conditions. Following that inspection we need to agree with the property owner that all of the identified "unsafe items", including the originally identified but not corrected items need to be fixed. Finally, the property owner needs to recognize that his personnel attorney needs to draft the release for Mr. Connelly's signature. What do you think? Chris: I have reviewed the file materials. With respect to the multiple dwelling units or setback issues, I think we have to consider them a non -conforming use. For whatever reason the county seems to have allowed the use under their zoning and development regulations. With respect to the code violations I would say the same with the exception of anything we identify that constitutes a threat to public health, safety, welfare or risk to the environment. If such is identified you should proceed as you would with any existing dwelling. With respect to their request that we release the title, I would be comfortable doing this only if the house met the current building codes (not including current zoning or setback requirements which I think are grandfathered). If the owner needs a release he should have an attorney prepare one for our review. I don't want to be in the position of drafting documents for someone who is not our client.
