Project Description: The project consists of one single-family residential lot situated on Parcel No. 45224.5006, Lot 6 of SHP-36-06. Surrounding uses consist of single-family residences and duplexes. Issue: Duplexes exist in the vicinity on lots that are approximately 12,000 square feet in size. Spokane County currently requires a minimum lot size of 10,000 square feet in the Low Residential (LDR) zone for duplexes. Allowing this exception makes the property more uniform to the other duplexes in the area. . Recommendation: Approve the request to reduce the minimum lot size for a duplex by 1 percent. SVMC 19.140.010 (E) allows a deviation of 25 percent or less of the required lot size. Applicable Regulations: Chapter 19.140 Administrative Exceptions (Applicable Condition) Section 19.140.010 Purpose An administrative exception may be considered only for adjustments necessary to correct errors resulting from the inadvertent and unintentional placement of structures or incorrect identification of lot boundaries in the following circumstances: Section 19.140.010.E —Lot area requirements where the deviation is for 25 percent or less of the required lot area. Section 19.140.020 Approval Criteria Criteria for approval or denial of applications shall be established by the director if it is shown that: A. ...does not detract from the character and nature of the vicinity in which it is proposed; B. ...enhances or protects the character of the neighborhood or vicinity by protecting natural features, historic sites, open space, or other resources; C. ...does not interfere with or negatively impact the operations of existing land use and all legally permitted uses within the zoning district it occupies; D. ...does not constitute a threat to the public health, safety and welfare within the City.
