Meeting Notes for June 14, 2007
Mr. Richard Ellingwood came into office at 3:45 p.m. to discuss Stop Work Orders
posted on two (2) of his structures, located on parcel 35231.1111. Mr. Tavis Schmidt
from the Planning Dept. and an unnamed individual representing Mr. Ellingwood's
interests were present, including myself representing the Building Dept.
I explained the reasons for the posting of the structures which were as follows:
Addition Permit #07001263
1.) Removing all walls, ceilings, and roof of the non -conforming structure that was
issued a permit for an addition only, would loose the status of non-conformance.
Since the structure was totally removed except for the foundation and deck, the
status would now transfer to being of new construction therefore eliminating the
non -conforming classification.
2.) The structure now being classified as "New Construction", the North side of the
structure does not meet minimum setbacks for the Planning Dept. which requires
five (5) feet from the side property line.
3.) Classified as new construction, plans and additional fees will need to be addressed
with an adjustment to the existing permit.
Remodel Permit #07002236
1.) Permit for the small house was evaluated to the scope of work that was authorized
with the plans that were submitted.
2.) Work on Permit #07002236 was stopped due to the violations on Permit
#07002236 to gain compliance with the Codes and Ordinances of the City of
Spokane Valley.
3.) With the Addition structure (07001263) being reclassified as new construction,
the issue of two (2) residential structures on one (1) lot now become a point of
determination and interpretation of the Planning Manager.
Mr. Ellingwood agreed to submit and pay any additional fees to bring the structure for
Permit 07001263 into compliance. However, it was stated that before he could proceed
with the Building Department he would first have to resolve the issue of setbacks and two
(2) residential structures with the Planning Department. The direction was given to talk
with Greg McCormick, the Planning Manager, in choosing an option to resolve the
setback and two (2) structure issue. The options were to;
1.) Remove the structure to a distance that would meet the setbacks.
2.) File for a Variance/Hardship Hearing.
3.) Provide a licensed survey showing the distance to property line and filing for an
Administrative Exception of 10% for the setback distance.
4.) Obtaining an interpretation from the Planning Manager in regards to non-
conforming uses and the two (2) residential structures on one lot or parcel.
Mr. Ellingwood stated to Mr. Schmidt that he would seek council with the Planning
Manager in choosing an option that would resolve the issue. I stated to Mr. Ellingwood
that no construction could take place or commence on Permit #07001263 until the
setback issue was resolved to the approval of the Planning Dept. However, I did state that
he could continue with the remodel for Permit #07002236 under the premise that as long
as he is working diligently towards finding a solution for the other residential structure.
