I am writing in response to your letter of September 12, 1997. According to my copy of
the site plan, if you disregard the "easement road" and add the number of feet from the
east side of the property, it seems that the number of feet is clearly over the easement
lines as shown on the plat map of Greenacres Irrigation District Block 27.
I have enclosed a copy of my site plan and plat map. If you notice, the measurement
from the east property line to the house is sixteen (16) feet. The house measures 47 feet
in width, the space between the storage building and the house measures 52 feet, and
finally, the storage building measures 40 feet in width. If these figures are added, the
total number is 155 feet. Since the total width of the properly is 165 feet and only 100
feet is free of easements, this clearly shows that the building is not located in the proper
place. I believe that too much attention was given to the "easement road" and less given
to the obvious east property measurements that have no questions or easements to bother
with.
I also understand that you told my contractor that the building was in the wrong place in
the beginning. If this is true, why was he allowed to build in the improper place and
caused me the headache that I currently have. I am working with my contractor at the
present time to get the building moved.
I realize that the County is not assuming any blame for this misplacement of my storage
building, but I did want to point out that this whole mess could have been avoided if
someone would have opened their eyes and seen the obvious mistake. I am an honest
person, and I would have never asked anyone to put this building in the wrong place. In
turn, I am having to pay the extra amount of money and the extreme amount of hassle of
not only having to move my building but also having to tear down and dispose of a 90
year old barn that is in very good shape.

Finally, my permit shows that it will expire within 180 days of its issue (April 11, 1997)
unless written request is given. I am requesting the extension of my permit in order to get
my building moved to the proper place. I am also requesting that the County does what it
can to assist me in placing my building in the proper place on the site map and avoid any
other undue costs to me. In addition, I would also request that the County issue any
additional permits free of charge, (i.e. to move the building) if needed, in order to get this
building done.

We have reviewed available alternatives to moving your storage building. As we discussed if
the short plat can not be altered to relocate the easement in which the building sits to the west
sufficient distance to meet the minimum setbacks then the building must be moved.
Our recommendation would be to work with your contractor to resolve this conflict. The
permit records indicate the site plan reflected the appropriate location for the building.
Further, discussions with the inspector indicated that verification of building setbacks was
based on information provided by your contractor.
Should you have any questions, please feel free to contact this office between the hours of 8:00
and 4:00 p.m., weekdays.
