Vandenberg East 18000 Indiana Avenue Greenacres, Washington 99016 Dear Mr. Vandenberg: Laws and regulations in our society are, at times, difficult to understand and fully comprehend. This is true of zoning ordinances, which are laws intended to protect and govern the many different uses of land in Spokane County. It is my responsibility, as the Code Coordinator, when the situation arises, to help resolve conflicts involving the Spokane County Zoning Ordinance. This office has received reports regarding the storage of inoperable vehicles on your property located at East 18000 Indiana Avenue, Spokane County parcel number 07554-1245. This property is zoned Agricultural. A recent visual inspection by our field inspector indicated, we believe, that these reports are accurate. Section 4.04.140 of the Spokane County Zoning Ordinance prohibits commercial auto repair. Section 4.03.020(32A) of the Spokane County Zoning Ordinance defines inoperable vehicles as follows: "Junk or Parts Vehicles" shall mean the remants or remains of a motorized or non -motorized device capable of being moved upon a public highway and in, upon, or by which any person or property is or may be transported or drawn upon a public highway and which is inoperative. Such term shall include, but not be limited to vehicle hulks, trailers, semi -trailers, tractors, motorcycles, trucks, and buses." Section 4.17.170 requires that storage of inoperable vehicles or parts thereof shall be in accordance with the following provisions: 1. No "Junk or Parts Vehicles" may be stored within the front, flanking street, or side yard setback area; and M. S. Vandenberg October 23, 1985 Page 2 of 2 2. All "Junk or Parts Vehicles" must be completely sight - screened year-round, from a non -elevated view, by a fence, hedge, shrubs or (maintained landscaped berm) (natural landscaped berm). It is the intent of this letter to advise you of an apparent zoning violation and to request compliance within a suitable time frame. Accordingly, we are of the opinion that since you have now been informed of the requirements of the Spokane County Zoning Ordinance, a period of thirty (30) days, beginning with the date of this letter, should be sufficient time in which to bring your property into compliance by either removing all inoperable vehicles and parts from the property or by screening the vehicles from view as required in Section 4.17.170 noted above. Do not hesitate to act upon this important matter, since a violation of the Spokane County Zoning Ordinance is a misdemeanor and does carry a penalty. Vandenberg East 18000 Indiana Avenue Greenacres, Washington 99016 RE: Storage of Inoperable Vehicles - East 18000 Indiana Avenue Dear Mr. Vandenberg: It has been some time now since we last contacted you regarding the storage of inoperable vehicles on your property located at East 18000 Indiana Avenue, Spokane County parcel number 07554-1245. A recent visual inspection by our field inspector indicates, we believe, that no action has been initiated to screen the vehicles or remove them from the property. As stated in our letter of October 23, 1985, you were given thirty (30) days in which to take corrective action. We appreciated your contacting this office on October 29, 1985 to explain the circumstances. The intent of this letter is to remind you of the requirements of the Spokane County Zoning Ordinance relating to the storage of inoperable vehicles and to encourage corrective action. An additional thirty (30) days is being extended in order to allow you sufficient time to comply with the Ordinance. Your compliance will negate the need for further action on this matter.
