Under Washington State's General Regulations for Air Pollution Sources - WAC 173-400- 030(47)(a), your operation qualifies as a "new source" which requires you to file a "Notice of Construction" to obtain a permit before installation of your air pollution source. A new source is defined as: "The construction of modification of a stationary source that increases the amount of any air contaminant emitted by such source or that results in the emission of any air contaminant not previously emitted..." This regulation and WAC 173-460 (Controls for New Sources of Toxic Air Pollutants) both require that any new source must use Best Available Control Technology (BACT) to control air contaminants. Auto body paint booths are designed to specifications arising from various organizations and local, state, and federal governmental agencies. Among these are the Uniform Fire Code (UFC), Uniform Building Code (UBC), Uniform Electrical Code (UEC), American Conference of Governmental Industrial Hygienists (ACGIH), The State and Territorial Air Pollution Program Administrators and the Association of Local Air Pollution Control Officials (STAPPA/ALAPCO), Spokane County Building Department, and Spokane County Air Pollution Control Authority (SCAPCA). I am enclosing a copy of the ACGIH and the STAPPA/ALAPCO guidelines and a copy of SCAPCA's Surface Coating Regulation. Basically, the ACGIH guidance sizes the fan required for ventilation, while the STAPPA/ALAPCO guidance sizes the filter bank. The Spokane County Building and Planning Department and the Fire Department have requirements concerning paint booths, also. Requirements from the UFC, UBC, and UEC can be obtained from Spokane County Building and Planning. A copy of this letter is being forwarded to them and the Fire Department. In order for me to perform the emission estimate calculations, I need the following information as well as the Environmental Checklist and the Notice of Construction Application completed and signed. I will be unable to process your Notice of Construction until I receive this information. Thank you for your cooperation. NOTE: Present SCAPCA Regulations Require the stack height to be 1.2 times the height of the highest building within 200 feet of the stack. Environmental ❑ • Environmental Checklist. (SEPA- Chapter 43.21 c RCW) An environmental checklist is required by the State Environmental Policy Act (SEPA) Chapter 43.21c RCW to address possible adverse environmental impacts. The environmental checklist must be complete. If a question is not applicable, insert N/A. The processing fee for the SEPA is $75 and must be paid at the time of the submittal. A 15 day public comment period is • Kustom Kars 12/28/95 Page 4 required by SEPA. The environmental checklist will be circulated to other interested governmental agencies for review and comment. At the end of the public comment period, all comments associated with air quality will be included in the final determination conditions. Comments not associated with air quality issues will be forwarded to you for your action. The environmental checklist must be signed by the owner or owner's designated responsible official. SEPA rules (Chapter 197-11-510 WAC) requires SCAPCA to publish a Determination of Non Significance (DNS) made by this agency in a newspaper of general circulation. You may want to do this yourself, however, the public notice must follow guidelines established in Chapter 197-11-340(2) WAC. SCAPCA generates this form automatically during the review process and will submit the publication for you without charge.
