Re: Vacation of Permit # 05-3605
Attached is the letter sent today to Mr. Barnes as well as a copy of SV BP#05-
3605.
Mr. Barnes purchased a building permit for an addition to a detached storage
building. According to information provided by Mr. Bames today, he had begun
excavation for the building foundation in late summer. The permit was
purchased in October.
No other construction work, outside of the excavation, has taken place at this
site.
The property at this address has exceeded the lot coverage allowed in our
Zoning Code by several hundred square feet and issuing a permit for this
proposed addition was not appropriate.
The permit for the original building that exceeded the maximum lot coverage
was issued in 1987 by Spokane County, and at that time, may have been
appropriate. However, now the extra size makes the property non -conforming.
We are arranging to refund Mr. Barnes' permit fee and I will write an apology
to accompany that check when the check is available.
I'm sorry this happened. I have spoken with staff and I hope that we have now
taken the steps to assure it won't happen again.

Mr. Barnes,
This is to inform you that the permit #05-3605 issued on October 7, 2005 has been
revoked and a stop order had been posted on December 30, 2005. The excavation for the
invalid permit, as we understand, was started prior to the issued date of the invalid
permit.
The existing buildings at this location are legal but are non -conforming and no
expansions are allowed on these buildings. These units can be used as storage but all
items must remain in the building. All vehicles or equipment must be contained inside the
buildings. There must be no outward appearance that it is being used for other than
residential.

Re: Your public record request relating to property complaint at 2419 East Main,
Spokane Valley, WA
Dear Mr. Barnes:
On January 3, 2006, Spokane Valley received your record request dated January 3, 2006,
in which you stated "I want to no who filed a complaint to city of valley on my project at
main and bessie." The City is required by state law to respond within five days to
requests for records. Although this response is within that time period, your request is
not for identifiable records. If you would like to request specific documents, including
the whole file, please let us know.
Under the Washington Public Record Act, RCW 42.17, governmental entities are
generally required to provide public records upon request. There are a number of
exemptions to the general rule, under RCW 42.17.310. This is not an exhaustive list,
with other exemptions having been recognized by the Washington appellate courts. Once
I receive a request for actual records, I will review the responsive documents to see if all
or portions need to be redacted.
In the event you request documents, the rate is set at $.15 per page under state law, plus
postage if you want us to mail them to you. Once the fee is paid, I can release any such
records to you.
