RE: Legal Status of Dwelling at 14623 E. Broadway
Dear Mr. Kiewert:
This letter responds to your request for verification that the residential structure at 14623 E.
Broadway is considered "legal" by the Spokane Valley Municipal Code. I have reviewed the
historic building permit file on this property and provide the following facts:
1. Prior to 1997, a duplex structure was constructed on the property without a building
permit.
2. The property was purchased in 1997 by the Scanio family and upon closing they were
informed that the duplex structure was not legally permitted.
3. Zoning for the property in 1997 was UR-3.5, which allowed only single-family and
duplex dwelling units. Triplex units were not permitted.
4. In order to make the property legal, Spokane County required the original dwelling and
the new, unpermitted dwelling to be attached via a breezeway to make it a "legal" duplex.
5. The Scanio's were required to remove a kitchen facility in the lower part of the
unpermitted structure and verify that the lower unit would not be used as a rental.
6. The Scanio family obtained proper building permits to convert the separate structures into
a "duplex" via a breezeway.
7. Spokane Valley's Municipal Code defines a duplex as "an attached building designed
exclusively for occupancy by two families, with separate entrances and individual
facilities for cooking, sleeping, and sanitation, but sharing a common wall. The
structure in question does not meet this definition and is therefore considered non-
conforming.

8. *Spokane Valley acknowledges that Spokane County determined that attaching the two
structures with a breezeway met their definition of a duplex.
Given these facts, I have concluded that the property contains a legal, non -conforming duplex.
