19-104.01 ERRG: Browns Park 2019 Improvements CONTRACT AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF
SPOKANE VALLEY AND ENGINEERING/REMEDIATION RESOURCES GROUP
Spokane Valley Contract#19-104.01
For good and valuable consideration,the legal sufficiency of which is hereby acknowledged, City and the
Contractor mutually agree as follows:
1. Purpose: This Amendment is for the Contract for Browns Park 2019 Improvements Project by and
between the Parties, executed by the Parties on June 26, 2019,and which called for substantial completion
by November 1,2019. Said contract shall be referred to as the"Original Contract"and its terms are hereby
incorporated by reference. Total compensation under the Original Contract is not to exceed$991,050.18.
2.Original Contract Provisions:The Parties agree to continue to abide by those terms and conditions of the
Original Contract and any amendments thereto which are not specifically modified by this Amendment.
The following provisions and associated costs are amended into the Contract.
Scope Provision Changes
a. Add Change Order#1 —Supply and install 4 hand dryers in the CTX restroom.
b. Add Change Order#2—Supply and install two electronic locks for the CTX restroom.
c. Deduct Change Order#3—Contains various items—see attached
d. Accept the approximately 150' section of perimeter path in the NW corner of the park that failed
subgrade compaction test without requiring contractor to remove and replace. Warranty does not
apply to that section that failed compaction testing.
e. Extend Contract Substantial Completion Date from November 1,2019 to May 31,2020.
Costs Changes
a. Change Order#1 $ 3,163.00
b. Change Order#2 $4,761.00
c. Change Order#3 $(15,715.00)
d. Time Extension $0.00
Total Amendment Change $(7,791.00)
3. Amendment Provisions: This Amendment is subject to the following amended provisions, which are
either as follows. All such amended provisions are hereby incorporated by reference herein and shall
control over any conflicting provisions of the Original Contract, including any previous amendments
thereto.
4. Compensation Amendment History: This is Amendment #_l of the Original Contract. The history of
amendments to the compensation on the Original Contract and all amendments is as follows:

The parties have executed this Amendment to the Original Contract this 11th day of June 2020.
