RE: Fire Hydrant Requirement of Mr. Tom Fagan
Dear Mr. Davis:
I am still in the process of reviewing the facts of this
matter so that I may make a determination of how to proceed.
In our telephone conversations, you made reference to Title
10, which apparently provides the requirements for installation
of fire hydrants in Spokane County. In our discussions, I think
we had established that the requirement was 900 feet from the
premies or residence. However, Mr. Wisenor of the Spokane Valley
Fire Department states that the requirement cannot exceed 700
feet. Consequentially, I am trying to ascertain what the
applicable rule would be to the property owned by Mr. Fagan.
I appreciate your help in resolving this matter.

Dear Mr. Fagan:
Laws and regulations in our society are, at times, difficult to
understand and fully comprehend. This is true of zoning ordinances,
which are laws intended to protect and govern the many different uses
of land in Spokane County. It is my responsibility, as the Zoning
Investigator, when the situation arises, to help resolve conflicts
involving the Spokane County Zoning Ordinance.
The County Planning Department, Mr. John Nunnery, has referred the
matter of no finalization of Preliminary Short Plat No. SP 83-221 for
resolvement.
A review of our records indicates that on June 27, 1983, you were
issued a building permit 83A-5836 for the construction of a
residence. A condition was placed on the building permit that no
occupancy may occur until the short plat has been finalized and
installation of an approved fire hydrant system. Further, on May
10, 1983, you submitted a notarized letter of understanding
acknowledging the finalizing and recording of the short plat prior to
the building of the residence beyond the footings and foundation
stages.
Even though your construction has been found to be in compliance with
the requirements of the Uniform Building Code as noted by our field
inspector, the terms of your building permit have not been satisfied.
Section 303 of the Uniform Building Code provides the authority for
the suspension or revocation of a permit whenever the permit is
issued in error or on the basis of incorrect information, or in
violation of any ordinance or regulation or any of the provisions of
this code.
It is the intent of this letter to advise you of an apparent code
violation and to request compliance within a suitable time frame.

informed of the conditions of building permit #83A-5836, a period of
30 days, beginning with your receipt of this letter, should be
sufficient time in which to bring your property into compliance by
completing the filing of the short plat as noted herein.
If the above mentioned time frame is insufficient, please contact
this office within 7 days in order that an equitable time frame might
be established in which your property will be brought into compliance
with the ordinance requirements.

these allegations to be unfounded, please feel free to contact me at

Mr. Fagan's property is located at East 17405 Broadway,
Spokane, Washington. Mr. Davis indicated to me that he was out
in the vicinity on Friday, September 21, 1984 and found a fire
hydrant located at East 17705 Broadway, approximately 800 feet
from Mr. Fagan's short plat. This hydrant apparently did not
appear on the County's records relied on in preparing the short
plat. Thus, it seems that Mr. Fagan is in compliance with Title
10 and need not install an additional fire hydrant. It is my
understanding that this short plat would not have required
installation of the fire hydrant had it been known that there was
an existing fire hydrant at the above referenced address.
I have been in contact with Mr. Davis
situation. Mr. Davis has been most cooperative
resolving this problem. Mr. Davis introduced me,
