• The City's initial review of a final plat/short plat/binding site plan application takes approximately thirty (30)
calendar days from the date of a complete submittal.
• During the 30-day review period, the City will distribute the final plat/short plat/binding site plan application
to other City departments and other affected agencies and organizations for their review comments.
• After receipt of all review comments, these comments will be provided to the applicant so that changes can be
made to the final plat/short plat/binding site plan map and any associated documents before submittal to the
City of the mylar for signature and any other documents intended for recording.

I. BACKGROUND INFORMATION
Size and Characteristics:
The site is 43,808 square feet or lacre. The site characteristics consist of
trees, grass and shrubs.

The site currently has a single-family residence and one detached structure.
II. FINDINGS
A. COMPLIANCE WITH THE STATE ENVIRONMENTAL POLICY ACT (SEPA):
The Planning Division has reviewed the proposed project and has determined that the project is categorically
exempt pursuant to WAC 197-11-800 and Section 11.10.070.1 of the City of Spokane Valley Interim
Environmental Ordinance from environmental review under the provisions of the State Environmental Policy
Act (SEPA).
B. COMPLIANCE WITH IHE INTERIM SUB DIVISION ORDINANCE):
The Planning Division has reviewed the proposed short plat for conformity with applicable standards of the
Interim Spokane Valley Subdivision Ordinance Chapter 12.300 staff find that the public interest will be served
by the proposed short plat.
C. COMPLIANCE WITH SECTION IV.F (WATER AND SEWER CONCURRENCY INSIDE URBAN GROWTH
BOUNDARY) OF I'HE ADOPTED PHASE I DEVELOPMENT REGULATIONS
Section IV.F (Water and Sewer Concurrency Inside Urban Growth Area) specifies that new development shall
not be approved unless the proposal can demonstrate the availability of public sewer and water services. New
development must 1) be connected to a live (fully operational) public sewer at time of occupancy, or 2) be
located within the Spokane County Six -Year Capital Improvement Program area. The proposal consists of a
preliminary short plat request therefore qualifying as new development. A Certificate of Water Availability
was completed by Consolidated Irrigation District dated July 14, 2006 indicating public water is available to
serve the new development by means of connection to the existing water system. A completed Certificate of
Sewer Availability from Spokane County Division of Utilities dated July 12, 2006 indicates public sewer is
currently not available but located within the six (6) year sewer capital improvement program. The form
indicates the applicant/developer will construct or install necessary systems to provide for future sewer
connection. Based on the preceding, staff fmds that the proposal meets the concurrency requirements of
Section IV.F.
D. COMPLIANCE WITH SECTION 14.616(URBAN RESIDENTIAL-3.5) OF THE INTERIM ZONING CODE
The site has an existing single-family residence and an existing detached structure intended to remain. Section
4.15.1 (Residential Development Standards Table) of the Spokane Valley Interim Zoning Code specifies that the
maximum density for the UR-3.5 zoning designation is 4.35 dwelling units per acre. The proposal is to divide
one (1) acre into two (2) lots for single-family residences. The maximum density is based on net density
calculations, which subtracts all proposed public and private roads The City of Spokane Valley Public Works
department is not requiring dedication of public right-of-way and thus access to Long Road and Mission Avenue

are not deducted from the gross lot area. Based on the 1 acre that will be used to calculate net density the
potential number equals four (4) dwelling units. The total number of units proposed equals two (2) thus
representing a density of 2 dwelling units/acre.
Pursuant to Section 4.15.1 (Residential Development Standards Table) of the Interim Zoning Code the Urban
Residential-3.5 (UR-3.5) zone requires a minimum lot size of 10,000 square feet and eighty (80) feet of lot
frontage for all single-family residential lots. The proposed lot sizes are approximately 21,900 square feet and
all proposed lots meet the minimum eighty (80) feet of lot frontage. Staff fords all minimum residential
development standards as proposed are consistent with Section 4.15.1 (Residential Development Standards
Table) of the Interim Zoning Code pursuant to the proposed UR-3.5 zoning designation.
E. COMPLIANCE WITH THE INTERIM SHORELINE MANAGEMENT PROGRAM. INTERIM CRITICAL
AREAS ORDINANCE & INTERIM FLOOD DAMAGE PROTECTION ORDINANCE:
Section 3.20.350 (Subdivision and Other Proposed Developments) specifies criteria for the platting of land
within identified areas of special flood hazard. RCW 58.17.120 specifies that no plat shall be approved by any
city, town, or county Legislative authority covering any land situated in a flood control zone as provided in RCW
86.16 without the prior written approval of the Department of Ecology of the State of Washington. Pursuant to
Community Panel No. 530174 0300 C of the Federal Insurance Rate Maps for Spokane County, Washington
(Map Revised: September 30, 1992), the subject property is not located within a designated area of special flood
hazard.
III. PUBLIC COMMENTS
Findings:
No written public comments were submitted in response to the Notice of Application issued on October 13
2006.
Conclusion(s):
Staff concludes that adequate public noticing was conducted for SHP-33-06 in accordance with adopted public
noticing procedures.
IV. AGENCY COMMENTS
Findings:
Agency comments are attached as exhibits to the staff report and recommendation. The following agencies
submitted written comments for the proposal:

Staff concludes that SHP-33-06 as proposed is generally consistent or will be made consistent through the
application of conditions of approval with the approval criteria stated herein.
VI. DECISION
The Planning Division has reviewed the submitted application's conformity to applicable City regulations and
standards for the short platting of land within the City, as specified herein, and has decided to APPROVE
SHP-33-06 subject to compliance with the following conditions of approval:
A. General
The following are general conditions of approval that apply to SHP-33-06:
SPOKANE VALLEY COMMUNITY DEVELOPMENT DEPARTMENT — PLANNING DIVISION:
1. The approved preliminary short plat shall have a maximum of two (2) residential lots unless a
preliminary short plat modification is approved pursuant to Section 12.100.120 (Modifications) of
the Spokane Valley Interim Subdivision Ordinance.
2. Pursuant to Section 12.100.118 (Extensions of Time) an application form and supporting data for
time extension requests must be submitted to the Director at least thirty (30) calendar days prior to
the expiration of the preliminary plat approval.
3. Pursuant to Section 12.100.130 (Enforcement) any sale, lease, or transfer of any lot or parcel created
pursuant to the City's Interim Subdivision Ordinance that does not conform to the requirements of
the preliminary plat approval or that occurs without approval, shall be considered a violation of
Chapter 58.17 RCW, and shall be restrained by injunctive action and shall be illegal, as provided in
Chapter 58.17 RCW. Each sale, lease, or transfer of each separate lot or parcel of land in violation of
any provision of this ordinance shall be deemed a separate and distinct offense.
4. Pursuant to Section 12.100.116 (Expiration of Approval), the preliminary short approval for SHP-33-
06 shall automatically expire five (5) years after preliminary approval is granted unless a time
extension is approved for the project. If a request for an extension of time is not submitted and
approved, the preliminary approval expires and the short plat is null and void. The expiration date
for SHP-33-06 is therefore November 9, 2011.
B. Prior to final short plat application submittal, the applicant shall:
SPOKANE VALLEY COMMUNITY DEVELOPMENT DEPARTMENT —PLANNING DIVISION:
1. Pursuant to Section 12.300.132 (Professional Land Surveyor), a final plat shall be submitted and
shall be made by or under the supervision of a professional land surveyor who shall certify on the
final plat that it is a true and correct representation of the lands actually surveyed. All surveys shall
comply with the Survey Recording Act (RCW 58.09), Survey and Land Descriptions (WAC-332-
130), and the City of Spokane Valley's Interim Standards for Road and Sewer Construction, as
amended.
2. The submitted final plat application shall comply with all submittal requirements specified in
Chapter 12.300 of the City's Interim Subdivision Ordinance.
3. Pursuant to Section 12.300.142 (Filing) the City of Spokane Valley shall record with the Spokane
County Auditor's Office the final plat, upon receipt of all required signatures on the face of the
plat, provided that also pursuant to this Section, the applicant shall submit prior to recording all
required recording fees including appropriate fees to pay for the cost of three (3) copies of the

recorded final plat for distribution to the City of Spokane Valley Planning, Engineering and
Building Divisions.
4. Submit a final short plat containing the following note on the face of the plat: "All Lots within this
plat shall comply with the building setback requirements, maximum building height standard,
maximum lot coverage standard and other applicable lot development standards for the UR-3.5
zoning district or successor zoning designation to the extent permitted by Washington State law in
effect at the time of building permit application."
SPOKANE VALLEY COMMUNITY DEVELOPMENT DEPARTMENT —BUILDING DIVISION:
5. If any grading is conducted on the site, engineered grading permits shall be required per City of
Spokane Valley Municipal Code (SVMC) Chapter 10.15, Article II, subsection 10.15.120
(Residential Subdivision Grading)
SPOKANE VALLEY PUBLIC WORKS DEPARTMENT —DEVELOPMENT ENGINEERING DIVISION:
1. Frontage improvements are required on Long Road. Long Road is designated as a Collector Arterial
street. Frontage improvements include 18.5 feet of asphalt width from road centerline, Type B curb
and gutter (2 feet), 10 foot roadside swale, and a 5 foot sidewalk. The total width of improvements is
35.5 feet. Current right-of-way is 60 feet;'/ of the right-of-way being 30 feet. A border easement,
which extends to back of sidewalk, of 5.5 feet is required. This shall be designated on the final plat
language and map. The border easement width was determined assuming that the center of the road
coincides with the center of the right-of-way. Applicant to confirm right-of-way location and width.
Note — the building setback begins at the edge of the border easement.
2. Frontage improvements are required on Mission Avenue. Mission Avenue is designated as a Minor
Arterial street. Frontage improvements include 23 feet of asphalt width from road centerline, Type B
curb and gutter (2 feet), 10 foot roadside swale, and a 5 foot sidewalk. The total width of
improvements is 40 feet. Current right-of-way is 60 feet; % of the right-of-way being 30 feet. A
border easement, which extends to back of sidewalk, of 10 feet is required. This shall be designated
on the final plat language and map. The border easement width was determined assuming that the
center of the road coincides with the center of the right-of-way. Applicant to confirm right-of-way
location and width. Note — the building setback begins at the edge of the border easement.
3. Show any utility easements (i.e. Telephone, power, etc). Please reference the City's Interim
Subdivision Ordinance requiring all new utilities for the site being divided to be undergrounded.
4. Plat language will be determined at the time of final plat submittal. Contact Public Works prior to
first submittal of final plat to obtain plat Language.
5. To construct the street improvements stated above, the applicant may, with the approval of the
Director of Public Works, join in and be a willing participant in any petition or resolution which
purposes is the format of a Local Improvement District (LID) for said improvements pursuant to
RCW 35.43, as amended. At such time as a LID is created or any Street Improvement Project is
sanctioned by Spokane Valley, the improvements required will be at the sole expense of the
undersigned owner, their heirs, grantees and assigns. This agreement extends for ten years from time
of approved final plat. This provision is applicable to Long Road and Mission Avenue which
provide access to the site.
6. As an alternative method of constructing the street improvements stated above, the applicant may,
with the approval of the Public Works Director, accomplish the street improvements by joining and
participating in a City Street Project (CSP) to the extent of the required street improvement. At such

time as a LID is created or any Street Improvement Project is sanctioned by Spokane Valley, the
improvements required will be at the sole expense of the undersigned owner, their heirs, grantees and
assigns. This provision is applicable to Long Road and Mission Avenue which provide access to the
site.
7. If frontage improvements are constructed, a Professional Engineer, licensed in the State of
Washington, needs to submit a fmal street and drainage plans and a drainage report including
calculations that conform to the 2001 Edition of the Spokane County Standards for Road and Sewer
Construction (or as amended), the 1998 Spokane County Guidelines for Stormwater management (or
as amended), Spokane Valley Ordinance 05-013 (or as amended) for stormwater treatment and all
other Federal, State and Local regulations.
8. Driveway for east lot to be located 7.5 feet from easterly property line.
9. Show any utility easements (i.e. Telephone, power, etc.). The permittee is responsible for arranging
for all necessary utility adjustments, relocations, or improvements as required for completion of the
project. The developer needs to contact the purveyors of each affected utility regarding private
service, utility improvement, and any relocation and adjustment costs. All rigid objects shall be
located out of the clear zone. These clear zone requirements can be found in the 2001 Spokane
County Road and Sewer Standards, or as amended.
10. For the installation of utilities (sewer, water, etc) in the Spokane Valley roadway system, the
applicant is required to submit civil plans which show the extents of pavement removal and
replacement; a cross section which shows existing lane width and replacement lane width, pavement
thickness, top course thickness, cross slope; profiles showing centerline, right and left edge of
pavements including grades and changes in elevation from existing, and how the replaced roadway
ties into existing (tapers, etc).
11. Driveway approach design shall follow the 2001 Spokane County Road and Sewer Standards, or as
amended. If at the time of construction Long Road or Mission Avenue do not have full -width
pavement or curb and gutter and if the improvements are proposed to be done through a LID, a rural
driveway approach may be used with the approach starting at the edge of the existing pavement.
12. If the newly created lots are used for any use other than single family residential, full improvements
to Long Road and Mission Avenue are required.
13. If frontage improvements are constructed, a landscaping plan, which shows the landscaping proposed
to be placed in vegetated stormwater facilities, such as channels, ditches, swales, ponds, etc., must be
submitted with the site construction plans for review.
14. A Temporary Erosion and Sedimentations Control (TESC) plan, prepared by a Washington State
licensed Professional Engineer, shall be prepared and submitted with the site construction plans and
will cover all construction activities for the improvements proposed in these plans. The TESC plan is
to follow 1998 Spokane County Guidelines for Stormwater Management.
15. Soils information: the data in the hardcopy version of the NRCS Soil Survey for Spokane County is
outdated and is no longer supported by NRCS. The latest soils information can be found online at
http://websoilsurvey.nres.usda.gov/app/
16. The Washington State Department of Ecology requires all drywells (existing and proposed) to be
registered through the state. Copies of the registration are to be sent to Public Works Department.

SPOKANE REGIONAL HEALTH DISTRICT:
6. The fmal plat shall be designed as indicated on the preliminary plat of record and/or any attached
sheets as noted.
7. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for
distribution by the Planning Department to the utility companies, City of Spokane Valley Public Works
Department, and the Spokane Regional Health District.
8. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County.
9. Water service shall be coordinated through the Director of Utilities, Spokane County.
10. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
11. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane Regional
Health District that an adequate and potable water supply is available to each lot of the plat.
12. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded
service area of the water system proposed to serve the plat.
13. Disposal of effluent beneath paved surfaces is currently prohibited.
14. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane Regional
Health District that a suitable site for an on -site sewage disposal system is available on lot B.
15. Subject to specific application approval and issuance of permits by the Health Officer, the use of an
individual on -site sewage disposal system may be authorized.
16. The dedicatory language of the plat will state: "Subject to specific application approval and issuance

18. The final plat dedication shall contain the following statement: "The public water system, pursuant to

SPOKANE COUNTY DIVISION OF UTILITES:
19. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on -site sewer
disposal systems may be authorized. This authorization is conditioned in compliance with all rules and
regulations of the Spokane County Health District and the development regulations of the governing
authority. It is further conditioned and subject to specific application approval and issuance of permits

by the Health District.
20. As per the development regulations/zoning code of the governing authority as amended, the dedication
shall state: To facilitate connection to the future public sewer system, each new building shall be
double plumbed with a dry side sewer for connection to future area -wide wastewater collection
systems. NOTE: Plans acceptable to the Division of Utilities may be required.
21. Any water service for this project shall be provided in accordance with the Coordinated Water System
Plan for Spokane County, as amended.
AVISTA:
22. A ten (10) foot wide utility easement strip is required along Mission Avenue.
23. Submit a final plat specifying the following note on the face of the final plat: "[DryjUtility easements
shown on the herein described plat are hereby dedicated for the use of serving utility companies for the
construction, reconstruction, maintenance, protection, inspection and operation of their respective
[Dry] facilities; i.e., fiber optic, cable, phone, natural gas and electric, together with the right to
prohibit changes in grade that will reduce the existing coverage over installed underground facilities

C. Prior to or during on -site construction the applicant shall:
SPOKANE VALLEY PUBLIC WORKS DEPARTMENT — DEVELOPMENT ENGINEERING DIVISION:
1. A pre -construction conference with Public Works is required prior to the start of construction. During
this meeting, standards and submittal requirements for the Construction Certification will be given to
the project engineer/inspector.
2. For construction affecting public right-of-way:
a. Thirty (30) days prior to construction, mail out 4" x 6" minimum size postcards to all residents
and businesses within 400 feet of the project limits and one copy to CSV Public Works
providing project construction details. The 400 feet will be up all streets, both sides, that
connect to the limits of construction. These addresses can be obtained from a Title Company.
b. Fourteen (14) days prior to construction, securely post a sign at each ingress to the project area
that is clearly visible from the right-of-way providing project construction details.
3. Permits are required for any access to or work within the right-of-way of the Spokane Valley roadway
system.
4. NOTICE — The Regional Pavement Cut Policy (County Standards, Technical Reference F) may
prevent or limit pavement cuts in the adjacent street(s). There is a three-year moratorium on pavement
cuts for newly paved streets. Please contact the City right-of-way inspector (Scott Wallace, 688-0053)
for further information.

5. The TESC structures (such as filter fence, silt ponds, silt traps) are to be installed prior to the start of
site work and maintained throughout the duration of construction and until the site has stabilized.
6. Upon completion of the frontage improvements, a Construction Certification package, prepared by the
Professional Engineer who prepared the civil site and drainage plans, is required for the improvements
and shall be submitted and approved prior to releasing the performance surety.
SPOKANE COUNTY MR POLLUTION CONTROL AUTHORITY:
7. Dust emissions during demolition, construction, and excavation projects shall be controlled.
Appropriate measures shall include but are not limited to the use of water sprays, tarps, sprinklers or
suspension of activity during certain weather conditions.
8. Measures shall be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved
surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean
these surfaces.
9. Debris generated as a result of this project shall be disposed of by means other than burning.
10. If objectionable odors result from this project, effective control apparatus and measures shall be taken
to reduce odors to a minimum.
11. Special attention shall be given to proper maintenance of diesel powered construction equipment to
reduce the impact of diesel exhaust, a suspended carcinogen.
12. A Notice of Construction and Application for Approval shall be submitted and approved by SCAPCA
prior to the construction, installation, or establishment of an air pollution source. This includes
emergency generators rated at 500 hp (375 kW) or higher, natural gas heating equipment units rated at
4 MMBTU/hr or higher (input), and heating equipment units fired with other fuels (e.g. diesel) rated at
1 MMBTU/hr (input) or higher. Contact SCAPCA for a Notice of Application.
13. A Notice of Intent shall be submitted to SCAPCA prior to any demolition project or asbestos project.
An asbestos survey must be done by an AHERA accredited building inspector prior to the demolition
or renovation of buildings to determine if asbestos -containing material is present at the site. Contact
SCAPCA for a Notice of Intent application.
QWEST:
14. Submit two (2) full size fmal plat maps with lot addresses noted and the serving power utility design at
least six (6) weeks before the developer's and/or builder's open utility trench date.
VII. APPEAL OF DECISION
Pursuant to Section 13.900 (Appeals) of the City's adopted "Application Review Procedures for Project
Permits", a written appeal of the Staff Report and Notice of Decision shall be filed with the City of Spokane
Valley Community Development Department within fourteen (14) calendar days after the date the notice of the

described property in a Local Improvement District (LID) and to support the formation of a LID for improvement of
the street(s) described below by requesting and authorizing the City of Spokane Valley to place their names on a
petition for the formation of a LID pursuant to RCW 35.43.120, or by requesting and authorizing the City of Spokane
Valley to cast their ballot in favor of a LID being formed under the resolution method pursuant to RCW 35.43.140
and .150, and/or by not filing a protest against the formation of a LID being formed under the alternate resolution
method provided for in RCW 35.43.
If a LID is proposed for improvement of the street(s) described below, said owner(s) and successor(s) further agree:
(1) that the improvement(s) or construction contemplated within the proposed LID are feasible and (2) that the
benefits to be derived from the formation of the LID by the property included therein, together with the amount of
any City participation, exceed the cost and expense of formation of the LID, and (3) that the property within the
proposed LID is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s) shall retain
the right, as authorized under RCW 35.43.180, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of an LID by either petition or resolution method under
RCW 35.43, and to appeal to the Superior Court the decision of the City Council confirming the final assessment roll;
provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do
not exceed a figure equal to the increased true and fair value improvements add to the property.
It is further acknowledged and agreed that at such time as an LID is created or any City Street Improvement project
is authorized by the City of Spokane Valley, the improvements required shall be at the sole expense of owner(s) of
property within the LID or served by the improvements without any monetary participation by the City of Spokane
Valley.
The LID waiver contained in this agreement shall expire ten (10) years from the date of execution below. This
provision is applicable to Long Road and Mission Avenue.
The Border Easement as shown hereon is here by granted to the City of Spokane Valley and its authorized agents,
and to the public for road purposes, including but not limited to curbs, sidewalks, drainage, signage, and other usage
deemed necessary by the City of Spokane Valley Engineer for the safety and welfare of the public. No fence or
portion thereof will be constructed within said easement without permission of the City of Spokane Valley Engineer,
nor will any objects be placed in said easement that would obstruct the sight distance necessary for safe and
efficient vehicular movements. Any other easements granted or dedicated within the Border Easement area will be
subordinate to the rights created by this easement and are subject to the City of Spokane Valley's permit process
prior to usage.
Private Ingress, Egress, and Utility Easements are granted as platted and shown hereon for the reciprocal access and
non—exclusive utility service needs of the affected lots.
Existing easements recorded under Auditor's numbers ???? are to be continued with this plat.
This short plat is located over a sole —source aquifer. Treatment of storm runoff from driveways shall be provided.
The preferred method of treatment is to have the runoff from driveways sheet flow over lawn turf or native —type
grasses. If a ditch is to be used to collect runoff from driveways, the ditch must be grass —lined.
Properties may be located uphill and adjacent to this subdivision that periodically discharge stormwater runoff onto
individual lots within this plat. Stormwater runoff from nearby uphill properties should be expected, and during snow
melt periods or wet seasons the lots may be subjected to higher amounts of stormwater runoff than what is
normally observed or anticipated. Because stormwater runoff from adjacent properties has discharged onto this plat
prior to development, stormwater runoff will likely continue to do so after development.
The property owners within this plat are responsible for keeping open and maintaining the surface path of natural or
man—made drainage flow over and across their respective properties. If the property owners fail to maintain the
surface path of natural or man—made drainage flow, or drainage facilities on private properties, a notice of such
failure may be given to the property owners. If not corrected within the period indicated on said notice, the City of
Spokane Valley has the right to correct the maintenance failure, or have it corrected, at the expense of the property
owners. No structures, including fences, shall be constructed directly over or within a natural drainage channel or
drainage ditch without the expressed written consent of the City Engineer.
The City of Spokane Valley does not accept the responsibility of maintaining the drainage
course on private lots nor the responsibility for any damage whatsoever, including, but
not limited to, inverse condemnation to any properties due to deficient construction
and/or maintenance of drainage courses in drainage easements on private property.
Any building that is constructed on a lot in this plat shall be set at such an elevation
so as to provide positive drainage away from any drainage entry point to the building
(including but not limited to a window well, a window unprotected by a window well, or a
doorway). The lots shall be graded so that either a) all runoff is routed away from the
building and conveyed over the lot to a natural drainage swale or approved drainage
facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved
drainage facility. All drainage facilities for this plat, including any swales, shall be
constructed in accordance with the approved plans on file at the City Engineer's Office.
Any proposed changes to the approved road and drainage plans must be approved by
the City Engineer's Office prior to construction of said changes.
The lot owners within this plat shall maintain all natural drainage channels, drainage
ditches, and all water quality treatment swales situated on their respective properties,
and any portion of swale situated in a public right—of—way adjacent to their respective
properties. Maintenance of drainage facilities includes, but is not limited to, keeping open
and cleaning storm pipes, ditches, drainage ponds, swales, etc., replacement of drainage
facilities as needed, and maintaining live native —type dryland grasses or lawn turf in the
swales. The lot owners are responsible for removing, disposing, and replacing the soil and
grass sod located in drainage facilities situated within private lots at such time the City
Engineer deems necessary. Maintenance of the lawn turf within the swales shall also
include, but is not limited to mowing, irrigating, and keeping the area free of debris. The
lot owners shall be responsible for payment of all claims and other liabilities which may
become due for said maintenance responsibilities. The City of Spokane Valley does not
accept the responsibility to inspect and/or maintain the drainage easements, nor does
the City of Spokane Valley accept any liability for any failure by the lot owners to
properly maintain such areas. If the lot owners fail to maintain the drainage facilities in
conformance with the accepted drainage plan on file at the City Engineer's Office, a
notice of such failure may be given to the lot owners by the City Engineer. If not
corrected within the period indicated on said notice, the City has the right to correct
the maintenance failure, or have it corrected, at the expense of the lot owners.
The owner(s) or successor(s) in interest agree to join in any City —approved stormwater
management program and to pay such rates and charges as may be fixed through
public hearings for service or benefit obtained by the planning, design, constructing,
maintaining, or operation of stormwater control facilities.
The City of Spokane Valley is responsible for maintaining the stormwater facilities located
within the public ROW as shown in the final plat documents. Maintenance shall include
cleaning the structures, pipes, and drywells.
The driveway access for the eastern lot is to be located 7.5 feet from the easterly
property line.
