Cooney • Senior Attorney It has come to my attention that you have illegally moved at least two (2) houses from a building site at the southeast corner of Sprague Avenue and Farr Road to County right-of-way property adjoining said property to the south. These houses apparently were sold to you or are in the process of being sold to you by Mr. and Mrs. Herman E. Hendrickson, the current owners of the building site. These houses were moved onto the County right-of-way without County approval, and constitute a safety hazard and liability concern for the County. In addition, the structures were moved without obtaining a permit from the County Building & Safety Department, in violation of Chapter 3.09 of the Spokane County Code, which is punishable as a misdemeanor. On May 20, 1988, Mr. Hendrickson asked the County Engineer's Office if a third house could temporarily be located on the County right-of-way. He was told that this would be tolerated only if all three houses were removed within the next few days. Twelve (12) days have now passed, and all three houses remain on County property. Mr. Ralph Guthrie - 2 - June 2, 1988 The County Building Department has advised me that you have applied for permits to move two of the houses. To my knowledge, no permit has been applied for to remove the third home. If these homes are not legally moved immediately, I will request that a criminal complaint be issued against you and the Hendricksons for violating County Code. If necessary, a civil action will be commenced to have these structures removed, and requesting that the costs of such action be assessed against the parties respon- sible. Since you have created this situation without legal authority, the County will not tolerate any delay based upon your claimed difficulty in finding a proper place to relocate these structures. Cooney • Senior Attorney Since our conversation on June 6, 1988, I have obtained a more complete version of the facts concerning the three (3) houses moved on to the County right-of-way at the southeast corner of Sprague Avenue and Farr Road. It appears that you contracted to purchase two (2) of the houses from the Hendricksons and moved these houses onto the County right-of-way. Paul and Patty Briethaupt contracted with the Hendricksons for the third house, which was also moved on to the County right-of-way. The first two houses were moved on to the County right-of-way without the County's permission and without notification to the County Building Department. Subsequently, on approximately May 20, 1988, the Hendrickson's requested the County's permission to move the third house onto the County right-of-way, and were told by Bert Haight of the County En- gineer's Office that this was acceptable provided that all three houses were moved off of the right-of-way in a few days. On May 20, 1988, the Briethaupt's contacted the County Building Department to apply for relocation permits and for permission to leave the houses on the County right-of-way. They were directed to the County Engineer's Office, where Jack Finney advised them that he would have no problem with the houses remaining on the County right-of-way for two weeks. Mr. Ralph Guthrie - 2 - June 10, 1988 On June 1, 1988, Bert Haight sent a letter to the Hendricksons demanding that the houses be moved by June 6, 1988. As I understand it, the Briethaupts recontacted Jack Finney on June 3, 1988. Mr. Finney advised that he could not give them anything in writing, because this would constitute a license agreement requiring the approval of the Board of County Commissioners. However, I'm told that he stated that he could see no problem with the houses remaining for two (2) more weeks, which would be June 17, 1988. I have been authorized by the County Building Department and the County Engineers Office to advise you and the Briethaupts that all three (3) houses must be moved off the County right-of-way no later than 5:00 o'clock P.M. on Friday, June 17, 1988. Further, the Building Department has advised me to instruct you and the Briethaupts, pursuant to Spokane County Code Section 3.09.050(e)- (3) that during the interim, the houses are to be secured in a safe manner, and securely blocked to resist normal wind forces. We suggest that skirting be placed around the houses as a safety measure, and that general liability insurance be maintained on the houses to protect yourself and the County from liability.
