PROBABLE CAUSE
THOMAS L. DAVIS, being first duly sworn on oath, deposes and says:
That I am employed as a Code Compliance Coordinator for Spokane County, Department of Building and Safety.
That in the course of II.
my employment I received information through a citizen complaint regarding alleged
violations of County codes and regulations.
Said complainant informed me that the owner of the move -on residential structure and a relocated
located at East 11915 Railroad Circle has failed to c ocatge
structures. SLY with County Code requirements involving relocated

That upon receipt of the foregoing
9 ng information, I conducted a thorough search of Building and Safety's permit
records. It was found that Section 3.09.050 of Title 3 of the Spokane County Code was violated in that the
residence was not brought into compliance with County Codes within the required six months of the date of permit
issuance.
V.
That file documentation revealed that on February 1, 1988 a building permit, nunber 87004214, was issued for
a relocated structure and detached garage. The owner of the property is Ralph Guthrie, East 13423 32nd Avenue,
Spokane, Washington. That the building permit clearly states the requirements for all relocated structures.
VI.
That on February 22, 1988, Reed Ockey, building inspector for the Department of Building and Safety, did
confirm that footings were poured and approved. On February 25, 1988 the foundation walls were inspected and
approved.
VII.
That on August 5, 1988 a notice of violation was sent to Mr. Guthrie by Certified Mail advising Mr. Guthrie
that the relocated residence and garage shalt be brought into compliance with code requirements and inspected on
or before August 20, 1988.
VIII.
Due to the failure of the owner, Ralph Guthrie, to comply with County Code requirements after due notice, and
the fact that the residence appears to be occupied, this matter is being forwarded to the County Prosecuting
Attorney's Office for legal action.
IX.
Based on the foregoing information, there is probable cause to believe that the above Ralph Guthrie did
criminally violate Section 3.09.050 of Title 3, Spokane County Code, by failing to complete the required code work
to render the residence safe to occupy, inclt yiny the garage.
