FIELD TRAVERSE METHODS USED WERE AS PER KNOW ALL MEN BY THESE PRESENTS, that James B. Herb and Riverview Community Bank have platted into lots the land hereon to be known as Short plat 1289 -01, situated in Spokane County, State of Washington. Said land being a portion of the N.E. 1/4 of Section 24, Township 25 North, Range 43 East, W.M., being more particularly described as follows: Lots 5 -9, Block 1, Empire'Heights Second Addition To Spokane, according to the Plat recorded in Volume "0 ", Page 20. • EXCEPT that portion of lots 7 through 9, "Block 1 of- Empire Heights Second Addition to Spokane, according to the Plat recorded in volume "0 ", page 20, Spokane County, Washington, described as follows: - Beginning at the Northwest corner of said Lot 9, thence S.8914'45 "E., along the North line of said Lots 7 through 9, 70.00 feet; thence S.0126'11 "W., along a line parallel to the West line of said Lot 9, 60.00; feet; thence N.89 °14'45 "W., along a line parallel to the North line of said Lots 7 through 9, 70.00 feet, to the West line of said Lot 9; thence N.01'26'11 "E., along said West line, 60.00 feet to the Point of Beginning. The property owners within this plat shall be held responsible for keeping open and maintaining the surface path of natural man -made drainage flow over and across their respective properties. If the property owner(s) fails to maintain the surface path of natural or man -made drainage flow, or the drainage swale, a notice of such failure may be given to the property owner(s). If not corrected within the period indicated on said notice, Spokane County has the right to correct the maintenance failure, or have it corrected, at the expense of the property owner. There may exist properties, located uphill and adjacent to this subdivision, which periodically discharge stromwater runoff onto individual lots within this plat. Runoff from nearby uphill properties should be expected, and during snowmelt periods or wet seasons the lots may be subjected to higher amounts of stromwater runoff that what is normally observed or anticipated. Because stormwater runoff from adjacent properties have discharged onto this plat prior to development, stromwater runoff will likely continue to do so after development. It is the responsibility of the individual lot owners to maintain existing surface paths of runoff through their respective lots and to grade the Tots in accordance with applicable rules and regulations, so as to prevent property damage. Any building that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive drainage away from any drainage entry point to the building (including but not limited to a window well, a window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from the building for a distance of at least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed away from the building, and conveyed over the lot to a natural drainage swale or approved drainage facility, of b) drainage intercepted on the lots is disposed of on the lot in an approved drainage facility. The approved drainage facility shall be constructed in accordance with any applicable accepted plans on file at the County Engineer's Office. Any revisions to the accepted drainage plans must be accepted by the County Engineer's Office prior to construction of said revisions. Spokane County does not accept the responsibility of maintaining the drainage course on private lots or floodplain areas within private Tots, nor the responsibility for any damage whatsoever, including but not limited to, inverse condemnation to any properties due to deficient construction and /or maintenance of drainage courses in drainage easements on private property. The owner(s) or successor(s) . in interest agree to join in any County - approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control facilities. This short plat is located within the Aquifer Sensitive Area (ASA). Treatment of storm runoff from driveways shall be provided. The preferred method of treatment is to have the runoff from driveways sheet flow over lawn turf or native -type grasses. If a ditch is to be used to collect runoff from driveways, then the ditch is to be grass - lined.
