KNOW ALL MEN BY THESE PRESENTS THAT Patrick and Melissa Barclay hove cuased to be platted
into tracts the land shown hereon to be known as Spokane County Short Plat SP 1308 -02, being
more particularity described as folows:
THE THEREOF; ; AND, LOT E10, OF LOT 9. EXCEPT THE NORTH EXCEPT THE NORTH 127.85 FEET THEREOF,
BLOCK 7, HUTCHINSON'S ADDITION, AS PER PLAT RECORDED IN
VOLUME 'Q" OF PLATS, PAGE 4, RECORDS OF SPOKANE COUNTY;
SITUATE IN THE COUNTY OF SPOKANE, STATE OF WASHINGTON.
The Plattors do hereby dedicate to Spokane County, for public use forever, a 30 foot radius
on the northwest comer of Boone Avenue and Marguerite Road for rood improvement purposes
as shown hereon.
The property owners within this plat shall be held responsible for keeping open and maintaining
the surface path of natural or man —made drainage flow over and across their respective
properties. If the property owner(s) fails to maintain the surface path of natural or man —made
drainage flow, or the drainage swale, a notice of such a failure may be given to the property
owner(s). If not corrected within the period indicated on said notice, Spokane County has the
right to correct the maintenance failure, or have It corrected, at the expense of the property
owner(s).
There may exist properties, located uphill and adjacent to this subdivision, which periodically
discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphill
properties should be expected, and during snowmelt periods or wet seasons the lots may be
subjected to higher amounts of stormwoter runoff than what is normally observed or anticipated.
Because stormwater runoff from adjacent properties have discharged onto this plat prior to
development, stormwater runoff will likely continue to do so after development. It is the

Any building that is constructed on a lot in this plat shall be set at such an elevation so as to
provide positive drainage away from any drainage entry point to the building (including but not

10 feet from the building. The lots shall be graded so that either a) all runoff is routed away

Spokane County does not accept the responsibility of maintaining the drainage Course on private
lots or floodplain areas within private lots, nor the responsibility for any drainage whatsoever,
including, but not limited to, inverse condemnation to any properties due to deficient construction
and /or maintenance of drainage courses in drainage easements on private property.
The owner(s) or successor(s) in interest agree to join in any County— approved stormwater
management program and to pay such rotes and charges as may be fixed through public
hearings for service or benefit obtained by the planning, design, constructing, maintaining or
operation of stormwater control facilities.
This short plat is located within the Aquifer Sensitive Area (ASA). Treatment of stormwater runoff
from driveways shall be provided. The preferred method of treatment is to have the runoff from
driveways sheet flow over lawn turf or native —type grasses. If a ditch is to be used to collect
runoff from driveways, then the ditch is to be grass — lined.

It is further acknowledged and aclreed that at such time as a RID is created or any County Rood
Improvement project is authorized by Spokane County, the improvements required shall be at
the sole expense of the owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. This provision is applicable to Boone Avenue and Marguerite Rood.
Setbacks shall be determined at ':he time building permits are requested unless these setbacks
are specifically drafted on this fir al short plat. The setbacks indicated on this subdivision may
be varied from if proper zoning or variance approvals are obtained.
Public sewers shall be constructed to provide for the connection of each parcel to the County's
system of sewage. Uses on properties within the project shall be required to connect to the sewer
and pay applicable charges per the County Sewer Ordinance. Sewer connection permits shall be
required.
A public sewer system will be made available for the project and individual service will be
provided to each tract prior to sole. Use of individual on —site sewage disposal systems shall
not be authorized.
Use of private wells and water symtems is prohibited.
The public water system, pursuant to the Water Plan approved by county and state health authorities,
the local fire protection district. Division of Building and Code Enforcement water u all
be installed within this subdivision and the applicant shall provide for individual domes
service as well as fire protection to each tract prior to sale of each tract and prior to issuance of
a building permit for each tract.
