Berkseth and Barbara R. Berkseth, husband and wife, hereinafter referred to as the owner of the servient estate(Lot 2, Block I, Ponderosa 6th Addition) and Joseph L. Espinoza and Alice E. Espinoza, husband and wife, hereinafter referred to as the owners of the dominant estate(That portion of the NE 1/4 of Section 23, Township 25, Range 44 East of the Willamette Meridian, and being a portion of the unplatted parcel shown on the face of Ponderosa 6th Addition, as per plat recorded in Volume 16 of Plats, page 23, Records of Spokane County; said portion lying Northwesterly of the Southeast line of Lot 6, Block 2, Ponderosa 2nd Addition as per plat recorded in Volume 8 of Plats, page 43, Records of Spokane County; extended Southwesterly to the Easterly line of Lot 2, Block 1, said Ponderosa 6th Addition), WITNESSETH: RECITALS A. The owners of the dominant estate own That portion of the Northeast quarter of Section 23, Township 25, Range 44 East of the Willamette Meridian, and being a portion of the unplatted parcel shown on the face of Ponderosa 6th Addition, as per plat recorded in Volume 16 of plats, page 23, Records of Spokane County; Said portion lying Northwesterly of the Southeast line of Lot 6, Block 2, Ponderosa 2nd Addition as per plat recorded in Volume 8 of Plats, page 43, Records of Spokane County; extended Southwesterly to the Easterly line of Lot 2, Block I, said Ponderosa 6th Addition; Situate in the County of Spokane, State of Washington. Portion of Parcel No. 45321.0925 B. The owners of the servient estate own Lot 2, Block 1, Ponderosa 6th Addition, in the County of Spokane, State of Washington. Parcel No. 45321.2302 C. The owners of the dominant estate or their predecessors in interest had reserved a perpetual easement for ingress and egress to allow for maintenance of the drainage easement as described in document No. 8011190023 and document No. 8011190024 recorded in Spokane County, Washington over and across a 15 foot strip on the north side of Lot 2, Block 1, Ponderosa 6th Addition. D. All parties now wish to terminate such easement reservation. AGREEMENT In consideration of the above recitals and the mutual covenants hereinafter set forth, the parties agree as follows: 1. The perpetual easement for ingress and egress over and across Lot 2, Block 1, Ponderosa 6th Addition, County of Spokane, State of Washington is hereby terminated and shall no longer be an obligation upon the serviant estate. 2. The recording of the termination agreement shall serve as revocation of all prior written instruments which may have been recorded creating the easement herein terminated.
