Dear Lance,
First of all thank you for your cooperation and patience in resolving this matter. I
appreciate your input and point of view.
After looking further into our newly adopted code and considering the use, type of
construction and the size of the lot we have concluded that the best classification for your
building would be a "Congregate Residence" and a short plat will not be needed. The
definition from our building codes states " Congregate residence is any building or
portion thereof that contains facilities for living, sleeping and sanitation, as required by
this code, and may include facilities for eating and cooking, for occupancy by other than
a family. A congregate residence may be a shelter, convent, monastery, dormitory,
fraternity or sorority house but does not include jails, hospitals, nursing homes, hotels or
lodging houses".
In conclusion, I find that this classification binds the new residence to the church and
mandates that the building always be used in conjunction with the typical church
activities. I will place a copy of this letter in your building permit file.
