BACKGROUND
Chapter 8.12 RCW sets forth the procedures which the City of Spokane Valley must follow in conjunction
with condemning property far public use.
RCW 8.25.290 further requires, among other matters, that the City of Spokane Valley provide at least
fifteen (15) days' notice by certified mail to each and every property owner of record as indicated on the tax
rolls of the Spokane County Assessor to the address provided on such tax rolls before "final action" and
deeming specific property to be necessary for City purposes for each property potentially subject to
condemnation as provided in RCW 8.12.030 -.040 and initiating condemnation proceedings.
Additionally, the City of Spokane Valley must publish notice in the legal newspaper with the largest
circulation in the jurisdiction where such property is located once each week for two successive weeks before
the final action is taken. A second publication must also be given in the legal newspaper routinely used by
the potential condemnor, where such newspaper does not also have the largest circulation in the jurisdiction.
Both the notice to the property owners of record and the notice of publication must contain a general
description of the property such as an address; lot number, or parcel number and specify that condemnation
of the property will be considered during the final action. Notice must also describe the date, time and
location of the final action at which the potential condemnor will decide whether or not to authorize the
condemnation of the property.
NOTICE
NOTICE IS HEREBY GIVEN by the City of Spokane Valley City Council, pursuant to the provisions of RCW
8.25.290, that a public meeting will be held on:
TUESDAY, NOVEMBER 3, 2020, AT 6 P.M., or soon thereafter
The hearing will take place via ZOOM Meeting. Those wishing to make oral comments will be directed to a
link on the November 3, 2020 agenda to be added to the Speakers List. Those wishing to provide written
public comments should fallow the link on the agenda for Written Public Comments. Please note that for
requests to join the Speakers List, and those wishing to provide public comments, all must be received by
4:00 p.m. the day of the meeting. Until further notice, in response to. Governor Inslce's Proclamation,
members of the public may only attend Council meetings remotely. A link will be provided in that regard on
the November 3, 2020 Council agenda.
The PURPOSE of the public meeting will be for the City Council of the City of Spokane Valley, consistent
with RCW 8.25.290, to (1) take "final action" as provided for in RCW 8.25.290 and determine that it is
necessary for City purposes as provided in RCW 8.12.030-.040to acquirecertain portions of Spokane County
Assessor Parcel Number 45021.5907, and (2) determine whether or not to initiate condemnation proceedings
with regard to certain portions of Spokane County Assessor Parcel Number 45021.5907. -
Consistent with RCW 8.25.290, the following information is hereby provided:
