BOARD OF ADJUSTMENT OF SPOKANE COUNTY
FINDINGS AND ORDER REGARDING CONDITIONAL USE PERMIT & VARIANCE
CUE-9-73 - Multiple Family Dwelling Unit
VE-8-73 - Land Use Per Dwelling Unit
WHEREAS, Application has been presented to the Zoning Adjustor of
Spokane County by Edward B. Unicume requesting a Conditional Use Permit,
CUE- 9- 7 3 , and a Variance, VE- 8- 7 3 , to permit a 118 unit apartment housing
approximately 1,000 square feet of land per dwelling unit to be located in a
Commercial Zone, said property located at Soutn 100 and 200 Havana Street,
Spokane County, Washington and more particularly described as follows:
Section 23, Township 25 N., Range 43, E.W.M.
The West 1/2 of the NW 1/4 of the NW 1/4 of
the NW 1/4, except the South 150 feet of the North 180 ft.
of the East 300 feet of said section, situated in Spokane
County, Washington.
and,
WHEREAS, The Zoning Adjustor of Spokane County did, on the 5th day
of February, 1973, hold a public hearing as provided in Section 4.25 of Title 4
on the application of Edward B. Unicume, for a Conditional Use Permit and
Variance on the property in question,
and,
WHEREAS, The Zoning Adjustor did, on the 28th day of February, 1973,
formally act upon said application and did deny said application based upon
findings of fact, and reasons,
and,
WHEREAS, An appeal from the decision of the Zoning Adjustor of
Spokane County was filed on the 1st of March, 1973, by Edward B. Unicume
through his attorney, Willard J. Sharpe,
and,
WHEREAS, The Board of Adjustment of Spokane County did, on the
29th day of March, 1973, and the 5th day of April, 1973, hold public hearings
as prescribed in Section 4.25 of Title 4 on the application of Edward B. Unicume
for a Conditional Use Permit and Variance,
and,
WHEREAS, at said hearing, opportunity was afforded those favoring and
those opposing said application, and the Board of Adjustment having fully considered
the official records, evidence and testimony given and having made investigation
of the matter does hereby find:
1) That the property in question is approximately 2.7 acres, in area.
2) That the property in question has been zoned "Commercial"
since December 26, 1951.
3) That existing land uses adjacent to the property are commercial
and residential.
4) That the Zoning Adjustor denied the application CUE-9-73 and
VE-8-73 since he was of the opinion that the application did
not meet the criteria of 4.2 5. 03 0 (b) and 4. 03.02 0 (64) and
RCW 36.70.810 (2).
5) That the property in question is located in a commercial area and
can be served by the Spokane City Sewer System.
6) That the granting of the Conditional Use Permit and Variance will
not be detrimental to the general comprehensive plan and
surrounding properties.
NOW, THEREFORE, The Board of Adjustment does hereby approve the
application of Edward B. Unicume for a Conditional Use Permit CUE-9-73 and
a Variance VE-8-73 to allow a 118 unit apartment in a Commercial zone on said
described property and subject to the following conditions:
1) That the applicant connect the proposed development to the City
of Spokane City Sewer System and continue to maintain use of said sewer system
or until a satisfactory modification of said sewerage system is submitted and
approved by this Board.
