AEE-32-91BEFORE SPOKANE COUNTY PLANNING DEPARTMENT IN THE MATTER OF STREET FRONTAGE ADMINISTRATIVE EXCEPTION AEE-32-91 SCAFCO COMPANION FILE(S): CE-107-91 (A&B) ) FINDINGS OF FACT, ) CONCLUSIONS AND DECISION THIS MA1-i'bR, an application for street frontage Administrative Exception, has been received and decided upon, pursuant to e Zoning Code of Spokane County, Sections 14.506.020 7. and 14.506.040, on the day of May, 1991. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has been delegated the responsibility for rendering this decision by the Spokane County Director of Planning. 2. The proposal is to alter the boundary line between two existing lots whereby one lot will have 50 feet of frontage on a public road (stud end of Main Avenue); whereas, section 14.634.310 of the Zoning Code for Spokane County requires 90 feet of frontage. 3. The proposal is generally located in east central Spokane County, at the east end of Main Avenue, east of Faucher Road in the SW 1/4 of Section 13, Township 25 N, Range 43 EWM. 4. The current zoning of the property is Industrial - 3 (1-3); which zone has no minimum lot size. 5. In compliance with RCW 36.70.450, the Planning Department has determined that this proposal is generally consistent, as conditioned, with the Industrial category. 6. The project is exempt from the State Environmental Policy Act, pursuant to WAC 197-11-800(6)(b). 7. The narrow remainder portion is railroad right of way and is not adversely affected by being smaller and narrower. DECISION BASED UPON THE ABOVE Findings of Fact and Conclusions, the Administrative Exception application is hereby APPROVED as shown on the approved site plan and other file documents. CASE NO. AEE-32-91 SPOKANE COUNTY ADMINISTRATIVE EXCEPTION PAGE 2 CONDITIONS OF APPROVAL I. GENERAL 1. The following conditions shall apply to the applicant, owner and successors in interest and shall run with the land. 2. Failure to comply with any of the conditions of approval contained in this decision, except as may be relieved by the Planning Department, shall constitute a violation of the Zoning Code of Spokane County and be subject to such enforcement as are appropriate. 3. The Planning Department may administratively make minor adjustments to site plans or the conditions of approval as may be judged to be within the context of this approval. II. PLANNING DEPARTMENT 1. This parcel shall not be further subdivided unless consistent with RCW 58.17, the various county subdivision regulations and the Spokane County Comprehensive Plan for the area. 2. The applicant shall file, as soon as practical, with the Planning Department a copy of the segregation application necessary to recognize the subject property as an individual tax parcel, except that this condition shall not apply if the parcel is presently established with a parcel number. III. DIVISION OF BUILDINGS 1. None is applicable. IV. UTILITIES DEPARTMENT 1. None is applicable. V. HEALTH DISTRICT 1. The approval of this administrative exception for lack of minimum frontage on a public street does not constitute that a buildable lot exists for development of a residence. A residential structure is subject to application and approval of permits for building(s) and on -site sewage disposal system(s). Parcel size may be a critical factor. CASE NO.
