FILE # I-54-83 THIS MATTER, Being the consideration by the Board of Adjustment for Spokane County, is an appeal of an administrative action by the Spokane County Zoning Administrator in a decision to sign a building permit allow- ing a dog kennel in the Manufacturing Zone per Section 4.12.030 of the Spokane County Zoning Ordinance - Uses Permitted -- General, hereinafter referred to as the "Proposal", and the Board of Adjustment of Spokane County having held a public hearing on February 15, 1984, and having fully considered all testimony presented thereat, and having rendered a decision on the 15th day of February, 1984, CONTINUING said proposal to the next regularly scheduled meeting on March 21, 1984, does hereby make the following: FINDINGS OF FACT 1. That by letter dated February 14, 1984, both the appellant, Acme Concrete Company represented by James Frank, and the applicant, Spokanimal C.A.R.E. represented by John Montgomery, did request a continuance of this matter until the next regularly scheduled meeting to be held March 21, 1984. Basis for the request was to allow additional time for both parties to arrive at a compromise solution. The Planning Department staff supported the con- tinuation for the stated reasons. 2. That the proper legal requirements for advertising of the hearing before the Spokane County Board of Adjustment have been met. From the foregoing Findings, the Staff presentation of File No. I-54-83, the Board of Adjustment of Spokane County hereby continues the item to the regularly scheduled March meeting, which is March 21, 1984 at 9:00 a.m. BOARD VOTE: 4 - 0 TA - DATED THIS DAY OF , 1984. The withdrawal was a result of a private compromise solution achieved by both parties as provided for by the Board of Adjustment in Finding #1 above. Spokane County and the Board of Adjustment were not parties to the agreement between Acme Concrete Company and Spokanimal C.A.R.E. Provisions of the agreement are not binding on Spokane County and will not be enforced by Spokane County).
