VARIANCE
VE-164-79, RELAXATION OF SETBACK REQUIREMENTS
ZONING ADJUSTOR DECISION: After public testimony and review, the decision
of the Zoning Adjustor is to approve the applicant's request for a Variance.
A.
FINDINGS: Pursuant to Section 4.25.030 of the Spokane County Zoning
Ordinance, the Zoning Adjustor has the responsibility of determining that the
granting of this application will not be detrimental to the surrounding
properties. In assuring compatibility, the Zoning Adjustor based his decision
on the testimony presented at the above noted Zoning Adjustor Hearing as well
as criteria set forth in the Spokane County Zoning Ordinance for review of this
application. The Zoning Adjustor hereby finds the following:
1. Applicant's proposal is to provide additional space in his building so as to
comply with Washington State Law regarding provision of lunchroom
facilities for his employees.
2. The flanking street (Dollar Avenue) is not a through street and appears to
serve as a drive utilized by the few businesses and railroad in the area.
3. The Zoning Adjustor notes that the Restricted Industrial zone is being
re-examined by the Planning Staff and Planning Commission to possibly
modify its setback requirements allowing greater utilization of space.
4. The Zoning Adjustor noted that there are existing similar uses within the
area and that the granting of this Variance would not constitute a granting
of special privileges.
B. ORDER:
Applicant's request is hereby approved and with the following stipulations;
1. Applicant's structure may locate within 11'6" of the flanking street (Dollar
Avenue) .
2. The applicant shall maintain his site design in substantial conformance with
the "plot plan" on file with this application, and in any case, shall observe
all other setback requirements as prescribed by the Spokane County
Zoning Ordinance.
3. Applicant agrees to join a future RID or CRP for the improvement of Dollar
Avenue.
