FRANCHISE TO Comcast Cable Communications Manage- ment, LLC TO CONSTRUCT, maintain and operate CERTAIN FACILITIES within the public rightS-of-way of the City OF SPO- KANE VALLEY, AND OTHER MATTERS RELATING THERETO. Section 1 grants Comcast Cable Com- munications Management, LLC, a non- exclusive franchise to construct, maintain and operate a cable system in the City's rights -of -way; Section 2 states that any renewal of this franchise shall be governed by and comply with the provisions of the Cable Act as amended; Section R states that nothing herein shall be deemed to direct or restrict the City's ability to adopt and enforce all necessary and appropriate ordinances regulating the performance of the conditions of this franchise; Section 4 adopts by reference chapter 3.65 Spokane Valley Municipal Code; Section 5 addresses severability Section 6 sets out information for notices of the parties; Section 7 sets the choice of law for which courts any litigation shall occur, Section R includes a non -waiver clause; Section 9 states this franchise constitutes the entire agreement, Section 19 speaks to acceptance, and Section 11 provides for an effective date.
