VARIANCE
VE-81-78, Frontage Requirement
ZONING ADJUSTOR DECISION: After public testimony and review, the decision of the
Zoning Adjustor is to approve the applicant's request for a Variance from the Frontage
Requirement.
A. FINDINGS FOR APPROVAL: Pursuant to Section 4.25.030 (b) of the Spokane County Zoning
Ordinance, the Zoning Adjustor has the responsibility of determining that a use will
not be detrimental to the surrounding properties. In determining compatibility, the
Zoning Adjustor based his decision on the testimony presented at the July 26, 1978
Zoning Adjustor Hearing as well as criteria set forth in the Spokane County Zoning
Ordinance for issuance of a Variance. The Zoning Adjustor hereby finds the following:
It was found that the strict application of the Zoning Ordinance would deprive
the subject property of rights and privileges enjoyed by other properties in the
vicinity.
2. The granting of this Variance, in the opinion of the Zoning Adjustor, is not a
granting of special privileges as evidenced by other properties having the same
rights and privileges in the vicinity and under identical zone classification.
3. The applicant was able to demonstrate to the satisfaction of the Zoning Adjustor
that the Eagles' Lodge can be constructed in compliance with the other provisions
of the Spokane County Zoning Ordinance.
4. The granting of this Variance on a parcel of land of this size will not be detri-
mental to the public welfare or surrounding.
B. CONDITIONS:
1. Prior to the issuance of a building permit, the applicant shall submit evidence to
the satisfaction of the Short Plat Administrator which indicates compliance with
the Spokane County Short Plat Ordinance.
2. Spokane County assumes no obligation for said private road and the owner or owners
hereby acknowledge that the County has no obligation of any kind or nature whatso-
ever to establish, examine, survey, construct, alter, repair, improve, maintain,
or provide drainage or snow removal on said private access road.
3. Access permits from the Spokane County Engineers' Department shall be secured
prior to the issuance of building permits.
4. A drainage plan shall be submitted and
the release of building permits.
5. All vehicular areas shall be paved and
accordance with the plot plan on file.
6. Access to the Eagles' Lodge shall be a 30ft. paved road with curbs from Sprague
Avenue to the Lodge.
7. The applicant shall work with the County Engineers' Department to secure proper
delineation of the Lodge from Sprague Avenue.

8. The applicant shall grant, at any time in the future, access to said private road
to property owners immediately south of the proposed lodge. This access shall
not be construed as frontage for purposes of obtaining a building permit. This
condition has been attached in order to mitigate any adverse effect that the lodge
might bring about because of increased traffic flow on Sprague Avenue and possible
channeling of said traffic.
