December 10, 2020
I. Chairman Johnson called the special meeting to order at 6:00 p.m. The meeting was held
remotely via ZOOM meeting.
II. Commissioners, staff and audience stood for the pledge of allegiance.
III. Administrative Assistant Taylor Dillard took roll and the following members and staff were

V. MINUTES: Commissioner Kaschmitter moved to approve the November 12, 2020 minutes
as presented. There was no discussion. The vote on the motion was seven in favor, zero
against and the motion passed.
VI. COMMISSION REPORTS: Commissioner Robinson reported that she took a walk on
Appleway Trail and it was lovely, but she suggested that it would be a good idea to
encourage better access for any new multi -family developments that occur. Chairman
Johnson stated that he continues to work with the Human Rights Task Force and he will be
joining the Gonzaga Hate Conference.
VII. ADMINISTRATIVE REPORT: Building Official Jenny Nickerson and the staff thanked
the outgoing Planning Commissioners James Johnson, Danielle Kaschmitter, and Walt
Haneke for their service on the Board. The new Commissioners have not been appointed yet
but should be named at the first City Council meeting of January.

IX. COMMISSION BUSINESS:
a. Information: Planned Residential Developments
Senior Planner Lori Barlow gave a staff presentation regarding Planned Residential
Developments (PRD). She explained that the Comprehensive Plan is a guide for growth
in the community and provides the framework for the development regulations. In 2016,
the Comprehensive Plan was updated with numerous goals and policies affecting
residential development. Chapter 19.50 of the Comprehensive Plan regulates all of the
implementing regulations for PRDs.
Planner Barlow explained that Spokane Valley Municipal Code (SVMC) 19.50.010
outlines the purpose of a PRD. The benefits of a PRD are design flexibility, preservation
of environmental amenities, open space and natural characteristics, and it encourages a
variety of housing types. PRDs are allowed in all residential zones. When a PRD is
approved, all residential uses are allowed within the PRD. This includes single family,
multifamily, duplexes, townhouses, cottages and neighborhood commercial (if the PRD
is 10 acres of land or larger).
Planner Barlow continued that SVMC 19.50.040 outlines the relationship of a PRD to
other Spokane Valley municipal code provisions and states that the provision of SVMC
19.50, pertaining to land use, of the underlying zoning district shall govern the use of
land in a PRD. SVMC 19.50.060 outlines the specific development standards. It
explains that specific setbacks, lot size, height limits, and other dimensional requirements
of the underlying zoning district are waived in a PRD. The elimination of lot size and
setbacks allow for design flexibility in development while preserving or creating open
space. There is a specification that the PRD perimeter be designed to minimize adverse
impact on adjacent properties and from adjacent land uses. The municipal code outlines
substantial open space requirements which includes 30% of the gross PRD area, must be
accessible to all PRD residents, and located within reasonable walking distance without
barriers. Stormwater facilities may be allowed as open space, if criteria are met.
Maintenance and operation are the responsibility of the Homeowners Association.
Planner Barlow then outlined the current review process for all PRDs received. When an
application is submitted it is determined complete by the Planning Department. A SEPA
checklist review is then completed and a threshold decision is issued. Public notice is
then sent to all property owners within 400 feet of the property. This determination is
published in the newspaper and posted on the site. A public hearing is then held which
includes a staff analysis and recommendation, applicant burden of proof and public
testimony. Finally, the matter is forwarded to the Hearing Examiner for final decision.
Commissioner Robinson suggested that the notices placed on the property site be bigger
so they are easier to read when passing the location. She stated that she would like to see
the City go beyond the minimum requirements to get the public involved in these big
projects.
Commissioner Beaulac asked if the City is published in the Spokane Valley Herald and if
it would be possible to move the publishing to the Spokesman Review. Planner Barlow
answered that the Spokane Valley Herald is the City's newspaper of record. However,
for large or controversial projects public hearing notices have been published in both
newspapers for additional circulation.

Planner Barlow explained that during the 2020 Comprehensive Plan Amendments, a new
residential zoning district (R-4) was added that allows a variety of housing types at
increased densities within a half mile of transit networks. This includes duplexes and
cottage developments.
Deputy City Attorney Erik Lamb gave a presentation regarding the newly adopted
moratorium on new planned residential developments. He stated that back on November
17, 2020, City Council directed staff to review the PRD regulations. On November 24,
2020 City Council adopted Ordinance 20-028 establishing a moratorium on submission,
acceptance, processing, modification and approval of PRDs. The reason for this adoption
was due to a concern that the range of housing allowed within the PRD regulations is
incompatible with surrounding uses in single family residential zoning districts. A
hearing will be held regarding the moratorium on January 5, 2021.
Deputy City Attorney Lamb explained that the reason for the moratorium is due to the
new housing policies that have been added to the Comprehensive Plan with the adoption
of the R-4 zoning district. This addition will help to preserve and enhance the City's
established single-family neighborhoods by minimizing more dense housing such as
duplexes and cottage developments in those areas.
Deputy City Attorney Lamb continued that due to this change to the Comprehensive Plan
the City Council requested that PRDs be evaluated to see if the range of housing allowed
within the PRD regulations was inconsistent with the direction of the newly adopted
changes to the Comprehensive Plan. Based on these changes and direction from City
Council, the denser housing should only be located in the new R-4 zones. Therefore, the
Planning Commission will review a code text amendment regarding PRD regulations
during January 2021 and hold a public hearing so that a recommendation can be made to
the City Council.
Commissioner Beaulac asked the property zoning for the PRD that was submitted for
consideration. Deputy City Attorney Lamb answered that the area is zoned R-3 and the
surrounding neighborhood is single family. The submittal included townhomes and
duplexes which caused concern from citizens and the Council that the submittal was not
consistent for the area.
Deputy City Manager John Hohman explained that the reason for this code evaluation is
to determine if PRDs are appropriate in single family zones on properties that are less
than five acres. Especially, since the City adopted the R-4 zone which allows for more
dense housing opportunities.
X. GOOD OF THE ORDER: All of the Planning Commission members expressed their
gratitude and respect for the service and leadership of Chairman Johnson and Commissioner
Kashmitter during their time on the board. Deputy City Manager John Hohman and Planning
Commission Secretary Deanna Horton also expressed their thanks for all of the hard work the
outgoing members have given to the Commission. Chairman Johnson and Commissioner
Kaschmitter thanked the Commission, the staff and the Council for the opportunity to serve.
XI. ADJOURNMENT: Commissioner McKinley moved to adjourn the meeting at 7:18 p.m.

BACKGROUND: In Washington, there are numerous laws to promote transparent and open government
by the legislative and appointed bodies that serve the people. These laws include the Open Public Meetings
Act (RCW 4230), the Public Records Act (RCW 42.56) and various laws setting forth ethics requirements
for municipal officers. As members of an appointed body, Planning Commission members are subject to
the requirements set forth in these laws. Staff will provide training and overview on the various open
government laws for Planning Commission members to meet training requirements for the Open Public
Meetings Act and to educate members on the other open government requirements.

AGENDA ITEM TITLE: Comprehensive Plan Orientation

BACKGROUND: The GMA allows local jurisdictions to consider amendments to their Comprehensive
Plans once each year. The City codified this process in Section 17.80.140 of the Spokane Valley Municipal
Code (SVMC).
Comprehensive Plan Amendments (CPA) are divided into two categories: map amendments and text
amendments. CPAs may be privately initiated or proposed by City Council, Planning Commission or staff.
As part of the annual comprehensive plan amendment cycle, the City Council is presented the proposed
amendments that may be considered for this year's amendment cycle. This process known as docketing.
The City Council reviews and approves the Docket, which is forwarded to the Planning Commission to
review the CPAs and make a recommendation to City Council for their final approval.
Tonight staff will provide an overview on the adopted Comprehensive Plan and implementing regulations
and provide additional detail on other long-range planning efforts and other economic development efforts.
