The Local Agency of City of Spokane Valley desires to supplement the agreement entered in to with David Evans and Associates,Inc. and executed on August 24,2017 and identified as Agreement No. 17-108 All provisions in the basic agreement remain in effect except as expressly modified by this supplement. The changes to the agreement are described as follows: Section 1, SCOPE OF WORK, is hereby changed to read: See attached Exhibit B,Scope of Services; I I Section IV, TIME FOR BEGINNING AND COMPLETION, is amended to change the number of calendar days for completion of the work to read: contract end date is revised to December 31,2022. III Section V, PAYMENT, shall be amended as follows: See attached Exhibit A.This supplement adds 250,000.00 to the previous contract amount of$2,846,854.33 for a total amount authorized of$3,096,854.33.The fixed fee amount is increased by 10,959.74 for a total of 152,899.16. as set forth in the attached Exhibit A, and by this reference made a part of this supplement. INTRODUCTION David Evans and Associates, Inc. (DEA) and associated subconsultants will provide on-call assistance to the City and WSDOT during bidding and construction of the project. This effort is limited to the budget of$250,000 including both labor and expenses. Labor and expenses for these services/tasks have been estimated and broken down for each service/task. However, the on-call services is strictly based on the requests of the City during the course of construction and is unknown at this time. The budget for the on-call services can be moved between tasks and between consultants, if needed, as long as the total remains under the $250,000.00 budget. If additional effort is requested by the City beyond the $250,000 limit, it will be performed under a supplement to this agreement. On-call services during the bid advertisement and construction may include the following: • Design support for addenda during the bid advertisement • Attendance at construction meetings as requested • Review of shop drawing and material submittals • Site visits to review proposed revisions to contract plans • Additional surveying and construction staking as requested by the City or WSDOT • Response to miscellaneous questions as requested by the City or WSDOT during the bid advertisement and construction • Design support for change orders • Coordination with BNSF during construction II. DETAILED TASK DESCRIPTION The following sections were established in Supplement No. 3, to implement the Phase II work and were updated in Supplements No. 7, 8 and the current No. 9. Support WSDOT's Project Engineer with submittals, RFI's, and review and design support for change orders as needed; b. participate in weekly construction meetings on an as-needed basis (see attached fee schedule for assumed staff hours); City of Spokane Valley Page 2 Barker Road/BNSF Grade Separation Supplement 9- Scope of Services It is assumed WSDOT will provide the following team members: 1. Project Engineer duties include: a. serve as primary project contact for Contractor; b. coordinate with CONSULTANT to resolve project issues; c. host pre-construction meeting; d. manage weekly construction meetings; e. review Contractor's contract forms including request to sublet and affidavit of wages paid; f. review Contractor certified payrolls; g. prepare monthly progress payments; h. prepare and manage Record of Materials (ROM); i. serve as clearinghouse for material submittals/shop drawings, maintain master log, and forward appropriate items to CONSULTANT for review; j. prepare change orders; k. review Contractor Request for Information (RFI's) and prepare response; I. coordinate with property owners for construction issues. 2. Resident Inspector duties include: a. attend preconstruction meeting; b. provide construction observation for the duration of the contract working days; c. prepare inspector daily reports; d. field verify materials delivered to jobsite; e. obtain truck tickets from Contractor for materials to be paid by tonnage; f. prepare material pay notes and project ledger to support WSDOT-prepared monthly progress payments; g. coordinate materials testing with a WSDOT-provided testing agency; h. coordinate with private utility company inspectors; i. photograph project conditions. Assumptions: 1. Contract duration is 20 months. 2. CONSULTANT will perform the work tasks described in the scope of services under the overall direction of the CITY. 19.1 Construction Phase Project Administration —DEA/HDR 19.1.1 Project Management— DEA/HDR Project management will be on-going during the course of the construction. DEA's and HDR's project manager will maintain communication with the CITY, WSDOT, and BNSF and will monitor the project's scope, schedule, and budget, City of Spokane Valley Page 3 Barker Road/BNSF Grade Separation Supplement 9- Scope of Services will coordinate and communicate with the project's subconsultants, and other similar project management tasks. ASSUMPTIONS: 1. New contract end date is December 31, 2022, however, project management level of effort duration will terminate August 31, 2022. 19.1.2 Subconsultant Coordination— DEA/HDR DEA will prepare subconsultant supplemental agreements for work included in this supplement. 19.1.3 Monthly Progress Reports and Invoices — DEA/HDR The CONSULTANT Team will continue to provide monthly progress reports and invoices in accordance with the CITY's standard procedures for the extended contract duration. ASSUMPTIONS 1. Progress Report and Invoice packages will be prepared monthly for 20 months. DELIVERABLES 1. Monthly Progress Report and Invoice Packages 19.2 Project Meetings and Coordination — DEA/HDR Preconstruction Conference: CONSULTANT will attend one pre-construction conference to support CITY and WSDOT (assuming one DEA and two HDR staff members will attend). Weekly Construction Meetings: CONSULTANT (DEA and HDR) will attend weekly construction meetings upon request from WSDOT's Project Engineer. Level of effort has been estimated; see attached fee schedule for assumed staff hours. WSDOT/CITY Coordination: CONSULTANT will coordinate with WSDOT's Project Engineer via email and/or teleconferences to identify CONSULTANT team support. Assumptions: 1. CONSULTANT team members will not generate meeting minutes. 2. Meeting minutes will be generated by WSDOT. 19.3 Construction Bid Assistance — DEA/HDR DEA and HDR will provide additional level of effort to answer questions and to assist the CITY and/or WSDOT during the advertising and bidding process. City of Spokane Valley Page 4 Barker Road/BNSF Grade Separation Supplement 9- Scope of Services 19.4 Utility Coordination &Verification — HDR CONSULTANT will perform utility coordination during construction as summarized below: • Support WSDOT with continued coordination with utility providers for relocations and new facility installations. 19.5 Geotechnical Construction Support— BA Budinger Associates will provide geotechnical services during construction as summarized below: • Install monitoring equipment in the HighEST parcel well and prepare pre- construction and post-construction well reports. • Prepare field activity reports summarizing observations when a Budinger representative is on site; Deliverables: 1. Field activity reports (PDF) 2. Well inspection reports (PDF) 19.6 Environmental Construction Support—Widener Provide cultural resource monitoring services during construction as summarized below: • Provide APE submittal support. • Develop Archaeological Monitoring and Discovery Plan (assume this Plan is to be reviewed by the CITY before construction begins). • Perform Archaeological Monitoring as requested by CITY or if conditions at the site deem this necessary. • Prepare Monitoring Report. Deliverables: 1. Archaeological Monitor Report (PDF and one hard copy) 19.7 Construction Surveying Support— DEA Provide on-call surveying and construction staking services as requested by the City or WSDOT during construction. Assumptions: 1. Level of effort has been estimated; see attached fee schedule for assumed staff hours. 19.8 BNSF Design Review Coordination - DEA CONSULTANT will submit revised bridge plans to BNSF for review. Level of effort has been estimated; see attached fee schedule for assumed staff hours 19.9 Field Support Services — DEA/HDR CONSULTANT will perform site visits during construction to assist the CITY and WSDOT. These visits will be performed on an as-needed basis and as directed by the CITY and/or WSDOT. Typical project construction activities that may warrant a site visit include: • Reviewing site conditions for any possible contract revisions; • Utility relocation and/or installation coordination; • Setting of girders; • Bridge deck and closure pours; • Final observation for substantial and physical completion. Assumptions: 1. Level of effort has been estimated; see attached fee schedule for assumed staff hours. 2. City/WSDOT will provide necessary forms to be completed for all requested site visits. 3. City/WSDOT will provide all necessary safety training prior to staff performing field visits. 4. The Contractor's railroad protective liability insurance will name DEA and HDR under their plan unless we stipulate without exception that DEA and HDR will never access BNSF ROW. Deliverables: 1. Site Visit Field Record (PDF) 19.10 Submittal Reviews — DEA/HDR Shop Drawings and Submittal Review: Review structural shop drawings and material submittals in accordance with WSDOT Standard Specifications and the WSDOT Construction Manual. CONSULTANT reviews will include a submittal review cover page with Engineer's signature, to be forwarded to the Contractor by WSDOT. Assumptions: 1. WSDOT will manage the master Submittal/Shop Drawing log and include a master submittal number on the transmission to the CONSULTANT, for tracking purposes. 2. City/WSDOT will provide necessary forms to be completed by CONSULTANT. Deliverables: 1. Submittal Review Package (PDF file via email or Projectwise) 19.11 Documentation Support— DEA/HDR CONSULTANT will provide on-call support to WSDOT to prepare and update various construction documentation elements such as modify and/or update the Record of Materials (ROM), prepare and/or update Submittal Log and RFI Log, etc. CONSULTANT level of effort is per an as-needed basis and level of effort has been estimated; see attached fee schedule for assumed staff hours. 19.12 Plan Interpretation & Change Orders — DEA/HDR • Respond to RFI's: Review RFI's proposed by the Contractor or required due to unforeseen circumstances. • Change Orders: CONSULTANT will review any change order requests either by the Contractor, CITY or WSDOT as requested by the CITY or WSDOT. The CONSULTANT will provide plan sheet revisions necessary for these change orders. Assumptions: 1. Level of effort has been estimated; see attached fee schedule for assumed staff hours. 2. WSDOT will provide an RFI Response form for CONSULTANT's use. 3. Review of working drawings and technical submittals will be returned to the WSDOT within five working days of receiving the submittals. Deliverables: 1. RFI Response form (electronic copy) 2. Change Order plans and/or supporting design documentation (electronic copy) 19.13 Final Bridge Load Rating Report- DEA The CONSULTANT will prepare a final load rating report for the proposed bridge in accordance with Chapter 13 of the WSDOT Bridge Design Manual. CONSULTANT will incorporate the comments from the Draft report into the Final report. Assumptions: 1. The CITY will review the DRAFT load rating report prepared in previous supplemental scope of work and provide comments to the CONSULTANT. Deliverables: 1. CONSULTANT will obtain, process and submit to the CITY and/or WSDOT items related to the closing of the construction project. The budget for this task assumes that project changes are minor in nature. CONSULTANT shall: • Assist WSDOT with a final punch list of work items yet to be satisfactorily completed by the Contractor; • Prepare "Record Drawings" markups in PDF using information generated by the CONSULTANT.
