DEBI LABISH being first duly sworn on oath deposes and says that she is the OFFICE MANAGER of the Spokane Valley
News Herald, a weekly newspaper. That said newspaper is a legal newspaper and it is now and has been for more than six
months prior to the date of publication hereinafter referred to, published in the English language continually as a weekly
newspaper in Spokane County, Washington, and it is now and during all of said time was printed in an office maintained at the
aforesaid place of publication of said newspaper, which said newspaper had been approved as a legal newspaper by order of the
Superior Court of the State of Washington in and for Spokane County. That the following is a true copy of a Legal Notice as it
was published in regular issues commencing on the 20th day of August, 2021, and ending on the 20th day of August, 2021, all
dates inclusive, and that such newspaper was regularly distributed to its subscribers during all of said period:

The lead agency for this proposal has
determined that this project does not have
a probable significant adverse impact
on the environment. Pursuant to WAC
197-11-350(3), the proposal has been
conditioned to include necessary mitigation
measures to avoid, minimize, or compen-
sate for probable significant impacts. An
Environmental Impact Statement (EIS) is
not required under RCW 43.21C.030(2)
(c). The necessary mitigation measures
are listed below. This decision was made
after review of a completed environmental
checklist and other information on file with
the lead agency. This information is avail-
able to the public on request.
Determination: This MDNS is issued under
WAC 1.97-11-340(2). The lead agency will
not act on this proposal for 14 days from the
date issued. Comments must be received by
5:00 p.m. on September 3, 2021.

Mitigation Measure:
1. Prior to the issuance of any Engineered
Grading Permit for any land disturbing
activities, the applicant shall submit a
Cultural Resource Survey, completed by a
qualified professional, to the Spokane Valley
Community and Public Works Department.
•In addition to the report, the developer
shall submit evidence of the acceptance/
concurrence with the findings in the report
from the Department of Archaeology and
Historic Preservation and the Spokane
Tribe of Indians.
2. The applicant shall dedicate an easement
for a Spokane Transit bus stop located along
Barker Road. The applicant shall coordinate
the easement size and location with City of
Spokane Valley Development Engineering
and Spokane Transit Authority. The bus
stop easement shall be subject to final ap-
proval by the City of Spokane Valley and
shall be shown and labeled on the final plat.
Appeal: An appeal of this determination
shall be submitted to the Community & Pub-
lic Works Department within fourteen (14)
calendar days after the date issued. The
appeal must be written and specific factual
objections made to the City's threshold
determination. Appeals shall be conducted
in conformance with Spokane Valley Munici-
pal Code (SVMC) 17.90 Appeals, and any
required fees pursuant to the City's adopted
Fee Schedule shall be paid at the time of
appeal submittal. Pursuant to WAC 197-11-
680, appeals shall be limited to a review of
a final threshold determination.
