18-123.02 Anytime Towing & Recovery: Towing Services CONTRACT AMIF�NDMENT TO THE AGREEMENT BETWEEN THE CITY OF S1OKANE VALLEY AND ANYTIME TOWING Spokane Valley Contract# 18-123.02 For good and valuable consideration, the legal sufficiency of which is hereby acknowledged, City and the Consultant mutually agree as follows: 1. Purpose: This Amendment is for the Contract for towingservicesfrom City property between the Parties, executed by the Parties on August 13, 2018, and which terminates on December 31, 2022 following exercise of the 'first two year renewal option. Said contract is referred to as the "Original Contract"and its terms are thereby incorporated by reference. 2. Original Contract Provisions: The Parties agree to continue to abide by those terms and conditions of the Original Contract and any amendments thereto which are not specifically modified by this Amendment. 3. Amendment Provisions:j This Amendment is subject to the following amended provisions, which are either as follows, or attached hereto as Appendix "A". All such amended provisions are hereby incorporated by reference herein and shall control over any conflicting provisions of the Original Contract, including any previous amendments thereto. The Scope of Services is changed by replacing the existing Scope of Services with this attached amended Scope of Services. This amended Scope of Services adds additional services to support road projects,and by amending the hourly rate for services. 4. Compensation Amendment History: This is Amendment # 1 of the Original Contract, and the compensation rates to Consultant continue to be contained in the revised Scope of Services. Compensation is based solely on usage at rates set forth in the revised Scope of Services. The parties have executed this Amendment to the Original Contract this day of August,2021. I. Towing from City properties-Within two hours of written authorization from an authorized City representative, Anytime Towing will remove a vehicle which remained parked overnight within the following places and tow those vehicles to a yard located within the City limits: A. The boundaries of the following City parks,which will be authorized by the City Parks and Recreation Department: 1. Mirabeau Park, located at 13500 East Mirabeau Parkway; 2. CenterPlace Regional Events Center, located at 2426 North Discovery Place; 3. Castle Park, located at 3415 South University Road; 4. Valley Mission Park, located at 11123 East Mission Road; 5. South Valley Mission park property/parking lot, located at 11202 East Mission Road; 6. Greenacres Park, located at 1311 North Long Road; 7. Park Road pool, located at 906 North Park Road; 8. Terraceview Park, located at 13525 East 24th Avenue; 9. Edgecliff Park, located at 800 South Park Road; 10. Flora Road park property, no assigned address but located east of Flora Road, immediately north of the Spokane River,and south of the Union Pacific rail line; 11. Sullivan Park/Western Dance Hall, located at 1901 and 2100 North Sullivan Road; 12. Balfour Park, located at 105 North Balfour Road, including the undeveloped portion east of Herald Road,between Sprague Avenue and Main Avenue; 13. Browns Park, located at 3101 South Pines Road; 14. Ponderosa undeveloped park property adjacent to the southeast corner of Bates Road and 44th Avenue; 15. Myrna Park, located at 22310 East Saltese Lake Road; 16. Flora Pedestrian Bridge trailhead, located at 17105 East Montgomery Avenue; and 17. Appleway Trail parking facilities located at Appleway Boulevard at Tschirley Road. B. The boundaries of the following other City properties: 1.City Hall,located at 10210 East Sprague Avenue,to be authorized by the Building Official; 2. Police Precinct Building located at 12716 East Sprague Avenue,to be authorized by the Spokane Valley Police Department; 3. Vacant property located at 12614 East Sprague Avenue, to be authorized by the Building Official; and 4. Street Maintenance Shop located at 17002 East Euclid Avenue, to be authorized by the Roads Superintendent. C. The cost for services provided pursuant to subsections A and B shall be as follows: $189 per hour—with a minimum of one hour per action request, increments of 15 minutes thereafter; $45 per day storage fee,with a minimum of one day,half day increments thereafter; $88 per hour fee will apply to customers requesting to get a vehicle or access to the vehicle for belongings after normal business hours of 8:00 a.m. to 5:00 p.m., Monday through Friday. D. Anytime Towing shall be responsible for installation and maintenance of all signage in parking areas relating to parking regulations, including towing pursuant to chapter 46.55 RCW. The City shall designate where all signs may be posted, and Anytime Towing shall consult with the City prior to posting a sign at any City facility to ensure each is posted in the proper location. Anytime Towing will replace any sign when it becomes damaged or unreadable, or at the request of the City at any time. II. Towing from rights-of-way relating to road projects - The City occasionally needs vehicles removed from a street construction zone, either during the preparation for or in the process of construction. The City adopted Resolution 17-003, which authorizes these project-related tows, and requires that certain conditions be met first with regard to notice to the vehicle owner. A. The City shall undertake all necessary steps required by Resolution 17-003 prior to requesting assistance from Anytime Towing for tows authorized by this Section II. B. The City shall attempt to provide Anytime Towing at least 24 hours prior to when a vehicle needs to be towed. The parties acknowledge that some vehicles will need to be towed with less notice. For those vehicles, Anytime Towing will respond and remove vehicles as directed in writing by the City within two hours. C. Vehicles removed pursuant to this Section II shall be towed to a spot on public right-of- way reasonably close to where the vehicle was towed from and released, which is anticipated to be within two blocks, as determined by parking availability. D.Anytime Towing shall photo-document the location from which each vehicle is removed and to where each vehicle is towed, with street addresses noted, and provide such information to the City Engineer or designee within four hours of completing the move. The City shall maintain this information in the project file, and at the front reception area for at least 30 days. E. The cost for services pursuant to this Section II is $189 per vehicle.
