18-162.01 WEST Consultants: Glenrose/Central Park Flood Insurance Study CONTRACT AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SPOKANE VALLEY AND WEST Consultants,Inc. Spokane Valley Contract# 18-162.01 For good and valuable consideration,the legal sufficiency of which is hereby acknowledged, City and the Consultant mutually agree as follows: 1. Purpose: This Amendment is for the Contract for a FEMA flood insurance study and floodplain map revision for areas within the Glenrose and Central Park watersheds by and between the Parties, executed by the Parties on October 16,2018,and which terminates upon fulfillment of contract scope. Said contract is referred to as the"Original Contract"and its terms are hereby incorporated by reference. 2.Original Contract Provisions:The Parties agree to continue to abide by those terms and conditions of the Original Contract and any amendments thereto which are not specifically modified by this Amendment. 3.Amendment Provisions: A. Section 3 of the Original Contract is hereby amended to modify the compensation from"$262,000"to "$280,584.16". B. The Original Contract is hereby amended to add and incorporate the services and costs for such services set forth in Exhibit"A-1"attached hereto. All references in the Original Contract to"Exhibit A"are hereby amended to include "Exhibits A and A-1". All references to costs in the Original Contract, including references to"Exhibit B",are hereby amended to include the additional costs set forth in Exhibit A-1. All such services and costs shall be in addition to all services and costs set forth in the Original Contract. All such amended provisions are hereby incorporated by reference herein and shall control over any conflicting provisions of the Original Contract,including any previous amendments thereto. 4. Compensation Amendment History: This is Amendment #1 of the Original Contract. This study will result in either a Letter of Map Revision (LOMR) or Physical Map Revision (PMR) depending on FEMA discretion. These basins include areas within the City of Spokane Valley (City), City of Spokane (Spokane) and Spokane County (County). All analyses and the floodplain mapping will be done in accordance with FEMA's Guidelines and Specifications for flood Hazard Mapping. Parties to this Project: • Consultant: WEST Consultants, Inc.—project lead • Participating Jurisdictions: City and possibly in the future, through an interagency agreement, Spokane and/or the County. Glenrose and Central Park LOMR/PMR Scope of Work Amendment No.1,Exhibit A-1 1 • Reviewing Jurisdictions: (at least) Spokane, the County and the Washington Department of Ecology (Ecology). • Advisory Group: a collection of up to six individuals volunteering to provide non-binding advice, review and comment to improve the quality of the project. The Parties shall cooperatively select the members of the advisory group in the manner they determine is appropriate. BACKGROUND In the contributing watersheds there are over 900 drywells that could possibly intercept stormwater and thus reduce the amount of flood flows. As not all of these drywells can be tested to determine their interception rates, it was determined that 10 would be selected to test and have these test results represent the interception rates of drywells in their vicinity. In the monthly project coordination meetings the selection of the representative drywells was discussed. It became apparent that a few more drywell tests would be needed to better represent the number and spatial distribution of the 900 drywells. 4 more tests were proposed. In the original Scope of Work, under Task 2, ALLWEST Testing Engineering Inc (ALLWEST) was identified as a subcontractor to: 1. Perform 10 dry well tests at$800/test=$8,000 2. Perform 2 pond infiltration tests at$600/test= $1,200 The budget for ALLWEST to perform these tests in the base contract was $9,200. In evaluating the circumstances around the 4 additional drywells tests it was found that supplemental traffic control,water trucks and water-supply permits would be needed at some sites.Also,for the pond infiltration tests a backhoe would be needed. Lastly,a report documenting all of the tests was requested. WORK PROGRAM ALLWEST shall accomplish the following additional work under Task 2 (Kick-off Meeting, Initial Site Visit, and Reconnaissance), providing the needed services and deliverables and WEST's administration of this work will be under Task 2 and/or Task 5 (Hydrologic Analysis). Deliverables shall be provided to the City, Reviewing Jurisdictions and Advisory Group, unless agreed to otherwise. The initial submittal of a deliverable will be a draft for review and comment. ALLWEST, through their subcontract agreement with WEST Consultants, will perform additional field work and reporting, including: 1. Additional reconnaissance on dry wells to be tested 2.
