ment. Pursuant to WAC 197-11-350, the
proposal has been conditioned to include
necessary mitigation measures to avoid,
minimize, or compensate tor probable sig-
nificant impacts. An Environmental Impact
Statement (EIS) is not required under RCW
43.21 C.030(2)(c). The necessary mitigation
measures are listed below and are imposed
pursuant to the Lead Agency's adopted
SEPA policies in SVMC 21.20.150. This
decision was made after review of a com-
pleted environmental checklist and other
information on file with the lead agency.
This information is available to the public
on request.
Determination: This MDNS Is Issued
under WAC 197-11-340(2) and SVMC
21.20.080. The lead agency will not act
on this proposal for 14 days from the
date Issued. Comments must be re-
ceived by 5:00 p.m. on December 3, 2021.

Mitigation Measure: The developer shall
install a bus stop on 4th Avenue to be lo-
cated in the westbound direction adjacent
to the development. The improvements
shall include a handicap accessible (ADA)
pad, eight feet by eight feet, that connects
to the sidewalk. The design and location
shall be coordinated with Spokane Transit
Authority, then subsequently incorporated
into the civil drawing for approval by the
City of Spokane Valley. Construction by
the developer shall be completed prior to
receiving the certificate of occupancy for
the first building of Phase 1.
Appeal: An appeal of this determination
shall be submitted to the Community & Pub-
lic Works Department within fourteen (14)
calendar days after the date issued. The
appeal must be written and specific factual
objections made to the City's threshold
determination. Appeals shall be conducted
in conformance with SVMC 17.90 Appeals,
and any required fees pursuant to the City's
adopted Fee Schedule shall be paid at the
time of appeal submittal. Pursuant to WAC
197-11-680, appeals shall be limited to a
review of a final threshold determination.
