21-116.01 AHBL: Balfour Park Improvements CONTRACT AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SPOKANE VALLEY AND AHBL,Inc. Spokane Valley Contract#21-116.01 For good and valuable consideration,the legal sufficiency of which is hereby acknowledged, City and the Consultant mutually agree as follows: 1.Purpose:This Amendment is for the Contract for design of Balfour Park Improvements by and between the Parties,executed by the Parties on August 2,2021,and which terminates on December 31,2023. Said contract is referred to as the"Original Contract"and its terms are hereby incorporated by reference. 2.Original Contract Provisions:The Parties agree to continue to abide by those terms and conditions of the Original Contract and any amendments thereto which are not specifically modified by this Amendment. 3. Paragraph 3 (Compensation) of the Original Contract is hereby amended to change the total compensation paid from$326,173.04,to$374,979.27. Paragraph 3 of the Original Contract is amended to read as follows: City agrees to pay Consultant an agreed upon hourly rate up to a maximum amount of$374,979.27 as full compensation for everything done under this Agreement,as set forth in Exhibit B and the added scope in Exhibit B.01. Consultant shall not perform any extra, further, or additional services for which it will request additional compensation from City without a prior written agreement for such services and payment therefore. 2. The Scope of Work, (Exhibit A) of the Original Contract, is hereby amended to include the following additional tasks and/or services: Consultant shall provide additional services as needed to;complete Phase 1 construction documents(New Task 6),include three additional soil samples with testing for lead&arsenic at the existing park(Task 2.1-Geotechnical Report),and decrease the maximum amount payable for Management Reserve(Task 5) per the added Scope of Work as shown on attached"Amendment 01-REVISED"which shall be incorporated into and become a part of the original Exhibit A-Scope of Work. 2 City of Spokane Valley—Balfour Park 21-116 Amendment 01 -REVISED AHBL No. 2210203 January 4,2022 EXHIBIT A.O1 Amendment 01 - REVISED Balfour Park Improvements Phase 1 Scope of Work and Fee Proposal Thank you for the opportunity to submit this revised proposal for Amendments to Contract Agreement 21-116 for design of Phase 1 of the Balfour Park Improvements project in the Spokane Valley. City of Spokane Valley (COSV) has requested that AHBL complete bid and construction plans, specifications, and estimates for the Phase 1 area of the park, as indicated in the attached Scope Site Plan. AHBL has engaged our team members, Integrus Architecture and MW Engineers, to provide similar services for the bathroom/storage building and Phase 1 park. This amendment adds Phase 1 construction documents to the project, with the intent to bid the Phase 1 Park package in January/February 2022. The 60% level is considered the Final Design Development (DD) Deliverable updated to address City comments. Additional scope of work will be billed to new Task 6 -Phase 1 Bid Documents (100%) of the signed Contract Agreement 21-116. This amendment also includes three additional soils samples with testing for lead and arsenic at the existing park under Task 2.1-Geotechnical Report, per the additional services proposal from GeoEngineers, while reducing the maximum amount payable under Task 5-Management Reserve. 6. Task 6 - Phase 1 Bid Documents (100%) 6.1. Revise park plans to incorporate COSV comments pertinent to Phase 1 elements. 6.2. Prepare 100% Construction Documents for the area indicated in the attached Scope Site Plan, including plans, elevations, sections, and details. This will include architectural and MEP plans for the restroom/storage building. 6.3. Bid documents will identify three bid alternate items, as indicated in the attached Scope Site Plan: 6.3.1. The Veterans' Memorial area. 6.3.2. Event's Plaza. 6.3.3. Relocating the existing playground structures with new fall zone materials. 6.4. Prepare site work project special conditions specifications in WSDOT/APWA format. Building and MEP specifications will be prepared as an exhibit in CSI format. 6.5. Deliverables: 6.5.1. 100% Phase 1 Plans and Specifications. 6.5.2. Phase 1 Final Engineer's Estimate and Bid Item List. 6.6. Reviews and Meetings: 6.6.1. Prepare agenda for and meet weekly with the COSV Project Manager. 6.6.2. Prepare agenda for and meet at least twice with the PC group for progress and full-page turn reviews of the plans. 6.7. Phase 1 permits are limited to the Building Permit for the restroom and the L&I electrical permit (site and restroom building). Our understanding is the park is a City CIP project and will not require any further permitting.
