BEFORE THE BOARD OF COUNTY COMMISSIONERS OF SPOKANE COUNTY,WASHINGTON IN THE MATTER OF THE TRANSFER OF ) GREENACRES TOWNSHIP PROPERTY ) TO THE CITY OF SPOKANE VALLEY ) RESOLUTION SPOKANE COUNTY ASSESSOR'S ) PARCEL NO. 55071.0230 - HATTAMER ) LANE ) WHEREAS, pursuant to the Washington State Constitution and laws of the State of Washington, Spokane County, Washington is a class A county duly organized and existing ("Spokane County"or"County"); and WHEREAS,pursuant to the provisions of RCW 36.01.030,the powers of Spokane County can only be exercised through the Board of County Commissioners of Spokane County, Washington("Board"or"Board of County Commissioners"); and WHEREAS, pursuant to the provisions of RCW 36.32.120(6), the Board of County Commissioners has the care of county property and management of county funds and business; and WHEREAS,pursuant to the provisions of RCW 45.80.010(now repealed),the Board of County Commissioners submitted to the County electorate at a special election held on November 5, 1974,a ballot proposition on whether or not the township organizations within Spokane County should be disorganized. A majority of those voting on the proposition favored disorganization (Yes-39,848; No-27,834). On December 30, 1974, the Honorable George T. Shields signed an order disorganizing all townships within Spokane County as of December 31, 1974. Upon the effective date of disorganization, the Board of County Commissioners, acting through the chairperson, became the statutory receiver for the purpose of winding up the affairs of the Township system as provided for under RCW 45.80.040 through 45.80.080; and WHEREAS, pursuant to the provisions of RCW 45.80.080, all township real property, buildings and furnishings and equipment used in connection therewith, other than cemetery real property,buildings, furnishings,and equipment used in connection therewith,as well as township halls,passed to the County in fee upon the effective date of the order of disorganization; and WHEREAS,Greenacres Township,located within Spokane County,State of Washington, acquired the following described property from Spokane Valley Irrigation District for the sum of $65 via Quit Claim Deed recorded April 16, 1941 under Recording No. 489085A,said Quitclaim Deed reserving all existing rights of way and easements over and across said property and also the right to at any time to go upon said property or any part thereof for the purpose of constructing, operating and maintaining canals, ditches, flumes, or pipelines, which shall by the Board of Directors of Spokane Valley Irrigation District be deemed necessary in the operation of its irrigation system. The property is described as follows: Assessor's Parcel No.55071.0230 A strip of land 20 feet wide extending along the northerly side of Tract Ninety-four (94), Plat 3, West Farms Irrigated Tracts, from the Northeast corner thereof a distance of 1428.6 feet westerly along said northerly line. Subject to all existing encumbrances, including easements, covenants, restrictions and reservations if any. ;and WHEREAS,the Final Plat of Hattamer Estates recorded April 7, 1994 shows the strip of land referenced in the immediately preceding recital as Assessor's Parcel No. 55071.0230 being an"Access Easement&Gravel Drive of Use"and gives the strip of land the name Hattamer Lane; and WHEREAS, a pole line goes down Hattamer Lane and mail boxes with addresses stating Hattamer Lane exist along Hattamer Lane and it appears that at least two lots would be landlocked without the use of Hattamer Lane for access;and WHEREAS,pursuant to RCW 35.02.180 the ownership of all county roads located within the boundaries of a newly incorporated city shall revert to the city and become streets as of the official date of incorporation. A county road is defined in RCW 36.75.010(6) as every highway or part thereof, outside the limits of incorporated cities and towns and which has not been designated as a state highway. A highway is defined in RCW 36.75.010(1 1)as every way, lane, road, street,boulevard and every way or place in the state of Washington open as a matter of right to public vehicular travel both inside and outside the limits of incorporated cities and towns. Property containing stormwater drainage facilities, which are part of the established roadway system, are also be considered as part of the county road upon incorporation under RCW 35.02.180;and WHEREAS,the County Engineer in reviewing the above recitals deem it to be in the best interest of the public that the hereinabove described property identified as Assessor's Parcel No. 55071.0230 be quit claimed to the City of Spokane Valley for road and utility purposes. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Spokane County, Washington, pursuant to the provisions of RCW 36.32.120(6), chapter 45.80 RCW(now repealed)and RCW 35.02.180,as well as the recommendation of the County Engineer, that the above described property identified as Assessor's Parcel No. 55071.0230 be quit claimed to the City of Spokane Valley for Road Purposes. The County Engineer or his appointed representative is directed and authorized to execute all documents on behalf of the County for the Quit Claim of the property to the City of Spokane Valley for road purposes consistent with RCW 2 35.02.180, except for the document conveying the property, which shall first be quit claimed to Spokane County by the Statutory Receiver for the Townships,the Chair of the Board of Spokane County Commissioners.
