WHEREAS, pursuant to the Washington State Constitution and laws of the State of
Washington, Spokane County, Washington is a class A county duly organized and existing
("Spokane County"or"County");and
WHEREAS,pursuant to the provisions of RCW 36.01.030,the powers of Spokane County
can only be exercised through the Board of County Commissioners of Spokane County,
Washington("Board"or"Board of County Commissioners");and
WHEREAS, pursuant to the provisions of RCW 36.32.120(6), the Board of County
Commissioners has the care of county property and management of county funds and business;
and
WHEREAS,Spokane County acquired Assessor's Parcel No.45233.2003 and Assessor's
Parcel No. 45233.2013 for drainage purposes to accommodate County Road Project 2791 and
County Road Project 2903.The property is described as follows:

The North 100.00 feet of the South 250.00 feet of the West 150.00 feet of
Tract 182 of Vera, according to the plat recorded in Volume"0"of Plats,
page 30.
Except Evergreen Road
Located in the Southwest Quarter (SW '' ) of Section 23, Township 25
North, Range 44 East,W. M., Spokane County,Washington.
Subject to all easements,covenants,restrictions and reservations of record.
Assessor's Parcel No.45233.2013
The North 200 feet of the South 350.00 feet of Tract 182 of Vera,according
to plat recorded in Volume "0" of Plats, page 30 in Spokane County,
Washington;
Excepting therefrom the east 369.00 feet and also excepting the West
150.00 feet thereof;
Located in the Southwest Quarter (SW 'A ) of Section 23, Township 25
North, Range 44 East,W.M., Spokane County, Washington.
Subject to all easements,covenants,restrictions and reservations of record.
; and
WHEREAS,pursuant to RCW 35.02.180 the ownership of all county roads located within
the boundaries of a newly incorporated city shall revert to the city and become streets as of the
official date of incorporation. A county road is defined in RCW 36.75.010(6) as every highway
or part thereof, outside the limits of incorporated cities and towns and which has not been
designated as a state highway. A highway is defined in RCW 36.75.010(11) as every way, lane,
road,street,boulevard and every way or place in the state of Washington open as a matter of right
to public vehicular travel both inside and outside the limits of incorporated cities and towns.
Property containing stormwater drainage facilities, which are part of the established roadway
system, are also be considered as part of the county road upon incorporation under RCW
35.02.180; and
WHEREAS,.Assessor's Parcels Nos. 45233.2003 and 45233.2013 should have been
transferred at the incorporation of the City of Spokane Valley and were missed; and
WHEREAS, Spokane County granted itself an easement for stormwater drainage and
access over these parcels by Instrument No. 4687268 recorded February 7, 2002 in Spokane
County; and
WHEREAS, the City of Spokane Valley has requested that the easement be released; and
WHEREAS,the County Engineer in reviewing the above recitals deems it to be in the best
interest of the public that the hereinabove described property identified as Assessor's Parcels Nos.
45233.2003 and 45233.2013 be quit claimed to the City of Spokane Valley for road and drainage
purposes and that the easement over these parcels be released.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Spokane County, Washington, pursuant to the provisions of RCW 36.32.120(6) and RCW
35.02.180, as well as the recommendation of the County Engineer, that the above described
property identified as Assessor's Parcels Nos.45233.2003 and 45233.2013 be quit claimed to the
City of Spokane Valley for Road and Drainage Purposes and that the easement over these parcel

for stormwater drainage and access be released. The County Engineer or his appointed
representative is directed and authorized to execute all documents on behalf of the County to
facilitate the Quit Claim of the property to the City of Spokane Valley for road and drainage
purposes consistent with RCW 35.02.180. The Quit Claim Deed to the City of Spokane Valley
will be signed by either the Chairman of the Board or a majority of the Board at other than an open
meeting.
PASSED AND ADOPTED by the Board of County Commissioners of Spokane County,
Washington this 18th day of January 2022.
