DEBI LABISH being first duly sworn on oath deposes and says that she is the OFFICE MANAGER of the Spokane Valley
News Herald, a weekly newspaper. That said newspaper is a legal newspaper and it is now and has been for more than six
months prior to the date of publication hereinafter referred to, published in the English language continually as a weekly
newspaper in Spokane County, Washington, and it is now and during all of said time was printed in an office maintained at the
aforesaid place of publication of said newspaper, which said newspaper had been approved as a legal newspaper by order of the
Superior Court of the State of Washington in and for Spokane County. That the following is a true copy of a Legal Notice as it
was published in regular issues commencing on the 4th day of February, 2022, and ending on the 4th day of February, 2022,

The following is the title and summary of
Ordinance No. 21-022 passed by the Spo-
kane Valley City Council on the 23rd day of
November, 2021:
AN ORDINANCE OF THE CITY OF
SPOKANE VALLEY, SPOKANE COUNTY,
WASHINGTON, GRANTING A NON-
EXCLUSIVE FRANCHISE TO THE YEL-
LOWSTONE PIPE LINE COMPANY TO
CONSTRUCT, OPERATE, MAINTAIN,
REMOVE, REPLACE, AND REPAIR EX-
ISTING PIPELINE FACILITIES FOR THE
TRANSPORTATION OF PETROLEUM
PRODUCTS AND BYPRODUCTS WITHIN
AND THROUGH THE CITY OF SPOKANE
VALLEY, AND OTHER MATTERS RELAT-
ING THERETO.
Section 1 defines certain words and terms
within the ordinance; Section 2 grants
Yellowstone a nonexclusive franchise
with limited rights and privileges; Section
3 states that the term of the franchise is
25 years, with possible additional 25-year
renewals; Section 4 addresses assign-
ment and transfer of franchise; Section
5 discusses compliance with laws and
standards; Section 6 addresses construc-
tion and maintenance; Section 7 states
that Yellowstone shall operate, maintain,
inspect and test its facilities to ensure full
compliance with laws, regulations and stan-
dards; Section 8 discusses encroachment
management; Section 9 addresses leaks,
spills, ruptures and emergency response;
Section 10 addresses relocation; Section
11 deals with removal and abandonment;
Section 12 discusses violations, remedies
and termination; Section 13 talks about
dispute resolution; Section 14 discusses
indemnification; Section 15 stipulates
insurance and bond requirements; Section
16 discusses receivership and foreclosure;
Section 17 mentions the franchise fee
and costs; Section 18 concems legal rela-
tions; Section 19 includes miscellaneous
issues such as legal processes; Section
20 concerns severability; and Section 21
provides for an effective date. The full text

above. A copy will be mailed upon request
to the City Clerk.
