conveys to the City of Spokane Valley,a municipal corporation of State of Washington,a RIGHT OF
WAY DEED oler the following described real property,situated in the City of Spokane Valley,Spokane
County; State of Washington,to-wit:

The City of Spokane Valley, as a part of the consideration hereof, does hereby agree as .a
covenant running with the land that in the event facilities are constructed, maintained, or
otherwise operated on the property described in this Right of Way Deed for a purpose for which
a U.S. Department of Transportation activity, facility, or program is extended or for another
purpose involving the provision of similar services or benefits, the City of Spokane Valley will
maintain and operate such facilities and services in compliance with all requirements imposed by
all current laws. rules and regulations such that no person on the grounds of race, color, or
national origin, will be excluded from participation in. denied the benefits of. or be otherwise
subjected to discrimination in the use of said facilities.

A five foot(5') strip of land being a portion of Lot 13, Block 12 of the plat of Corbin Addition to
Greenacres filed in Volume S of Plats at Pages 30 and 31, Records of Spokane County, Washington and a
portion of the adjacent vacated unnamed Right-of-Way lying in the Northeast Quarter of the Southeast
Quarter of Section 18,Township 25 North, Range 45 East, Willamette Meridian,City of Spokane Valley,
Spokane County, Washington and more particularly described as follows:
Commencing at the southwest corner of said Lot 13, Block 12,from which the southeast corner bears
North 89°54'00"'East a distance of 211.85 feet;thence along the West line of said Lot 13, Block 12,
North 00°11'23"West a distance of 75.17 feet to a point on the South right-of-way of Cowley Avenue,
which is twenty-five (25)feet parallel to and South of the centerline of Cowley Avenue, being a 5/8 inch
