consideration of mutual benefits,the receipt of which is hereby acknowledged,warrants and conveys to

of Washington,to-wit:
A parcel of land located in the Southwest quarter of Section 17,Township 25 North,Range 45 East,
Willamette Meridian, and being a portion of lots 3,4, 5 and 6 of Block 2 of the Final Plat of Garwood
Sub-Division of Corbin Addition to Greenacres, as recorded in Book X of Plats,Page 18,records of
Spokane County,Washington,and being more particularly described as follows;
a:
Beginning at the Northwest corner of said Lot 3. Said point being along the South right of way of Alki
Avenue, as shown in said plat;
Thence following said right of way, South 89°58'40"East,a distance of 306.04 feet,to the point where
the South right of way of Allci Avenue intersects the West right of way of Michigan Road;
Thence South 0°48'40"East, along said West right of way of Michigan Road,a distance of 211.30 feet,
to the Northerly corner of that portion deeded to the city of Spokane Valley by Statutory Warranty deed
recorded as Auditor's File Number 5554968;
Thence leaving said right of way, South 35°38'36"West, along the North line of said portion deeded to
the city of Spokane Valley,a distance of 23.39 feet,to a point 10.00 feet West of the right of way of
Michigan Road,when measured at right angles;
Thence running North 0°48'40"West, on a line 10.00 feet West of and parallel to said West right of way
of Michigan road, a distance of 195.27 feet,to the point of curvature of a curve to the left. Said curve
having a radius of 20.00 feet, and a delta angle of 89°10'00';
Thence along said curve, a distance of 31.13 feet,to a point 10.00 feet South of said right of way of Alki
avenue,when measured at right angles;
Thence running North 89°58'40"West,parallel with and 10.00 feet South of said South right of way of
Alki avenue, a distance of 276.31 feet,to a point on the West boundary of said Lot 3;
Thence running North 0°53'01"West along said West boundary,to the point of beginning, and the
terminus of this description:
Said parcel contains 5,224.6 square feet, or 0.12 acres,more or less.
The City of Spokane Valley, as a part of the consideration hereof, does hereby agree as a
covenant running with the land that in the event facilities are constructed, maintained, or
otherwise operated on the property described in this Right of Way Deed for a purpose for which
a U.S. Department of Transportation activity, facility, or program is extended or for another
purpose involving the provision of similar services or benefits, the City of Spokane Valley will
maintain and operate such facilities and services in compliance with all requirements imposed by
all current laws, rules and regulations such that no person on the grounds of race, color, or
national origin, will be excluded from participation in, denied the benefits of, or be otherwise
subjected to discrimination in the use of said facilities.
TO HAVE AND TO HOLD the same,unto the said City of Spokane Valley for the purposes of a public
road forever.
