21-197.02 CBRE Heery: City Hall Repairs CONTRACT AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SPOKANE VALLEY AND CBRE Heery,Inc. Spokane Valley Contract#21-197.02 For good and valuable consideration,the legal sufficiency of which is hereby acknowledged, City and the Consultant mutually agree as follows: 1.Purpose: This Amendment is for the Contract for Project Management/Owner's Representative services on the City Hall Repair project by and between the Parties, executed by the Parties on January 19, 2022, and which was to terminate on December 31, 2022, but was extended to June 30, 2023 with Amendment #1. Said contract is referred to as the"Original Contract"and its terms are hereby incorporated by reference. 2.Original Contract Provisions:The Parties agree to continue to abide by those terms and conditions of the Original Contract and any amendments thereto which are not specifically modified by this Amendment. 3. Amendment Provisions: This Amendment is subject to the following amended provisions, which are either as follows,or attached hereto as Appendix"A". All such amended provisions are hereby incorporated by reference herein and shall control over any conflicting provisions of the Original Contract, including any previous amendments thereto. 4. Compensation Amendment History: This is Amendment #2 of the Original Contract. Stairwell Remediation Based upon our review of expenditures to date and understanding of the remaining work we estimate an additional 45 hours of service to carry through completion.The additional hours are based upon the following: • Added time due to discovering and resolving a solution to missing structural bracing in both stairways. o This includes 9 short struts that were supposed to have been installed from a ceiling brace to the top exterior beam on 5 foot centers.This includes 7 struts in stair#3,and 2 in stair#1. o 2 long struts missing in stair#1 connecting the lower beam to the ceiling brace,and adding anchor bolts to the beam. Based upon the agreed hourly rate for Project Manager David Mendez the modification request is in the amount of$6,525.00 and the contract would breakdown as follows: Original Scope Cost Agreement $25,784 Modification Request($145/hr x 45hr) $ 6,525 Revised Cost $32,309 New Office on the Third Floor We are excited for another project to assist the City of Spokane Valley on,and understand you desire for us to manage the construction of the new office space on the 3'floor of the city hall building. We recognize the need for these specific costs to be kept separate from the other projects in which we are assisting and therefore needs to be tracked separately. For the construction/project management scope,we propose to continue the services of David Mendez based upon the relationship in which he has built with you and his understanding of your staff and practices. Per our original agreement,and based upon our best practices and understanding,we propose a cost in the amount of$11,409 per breakout below which is based upon the existing terms and conditions and will be performed on a time spent basis with a not to exceed price.
