ADJOURNMENT Meeting Minutes Spokane Valley Planning Commission Council Chambers — City Hall January 26, 2023 I. Planning Commission Chair Karl Granrath called the meeting to order at 6:00 p.m. The meeting was held in person and via ZOOM meetings. II. The Commissioners, staff, and audience stood for the Pledge Of Allegiance III. Administrative Assistant Marianne Lemons took attendance, and the following members and staff were present: Susan Delucchi Tony Beattie, City Senior Deputy Attorney Val Dimitrov Chaz Bates, Planning Manager Karl Granrath Greg Bingamin, IT Specialist Walt Haneke Marianne Lemons, Administrative Assistant Bob McKinley Nancy Miller Daniel Wilson IV. AGENDA: Commissioner Haneke moved to amend the agenda for January 26, 2023 as presented. There was no discussion. The vote on the motion was seven in favor, zero against and the motion passed. V. MINUTES: Commissioner Miller noted three changes that needed to be made to the minutes. There were two instances where "Commission" was used instead of "Commissioner" and one instance where Commissioner Granrath's last name was spelled incorrectly. Commissioner Haneke moved to approve the January 23, 2023 minutes as amended. There was no discussion. The vote on the motion was seven in favor, zero against and the motion passed. VI. COMMISSION REPORTS: Each Commissioner gave a brief personal background as an introduction to the two new Commission members, Dan Wilson and Val Dimitrov. VII. ADMINISTRATIVE REPORT: Planning Manager Chaz Bates reminded the Commission that the Planning Commission meetings will be held at Centerplace beginning in April. VIII. PUBLIC COMMENT: There was no public comment. IX. COMMISSION BUSINESS: a. Training: Public Records Training & Open Public Meetings Act 1-26-2023 Planning Commission Minutes Page 2 of 2 Deputy City Attorney Tony Beattie gave the annual public records and open public meetings training to attending Planning Commissioners and staff. b. Training: Annual Planning Commission Orientation Planning Manager Chaz Bates presented a training session regarding the Spokane Valley Comprehensive Plan, the Planning Commission Rules of Procedure, Robert's Rules of Order, and an introduction to projects currently under review by the planning staff. X. GOOD OF THE ORDER: The Commissioners welcomed the new members. XI. Karl Granrath, Chairman Date Signed Marianne Lemons, Secretary CITY OF SPOKANE VALLEY Request for Planning Commission Action Meeting Date: February 9, 2023 Item: Check all that apply ❑ old business ® new business ❑ public hearing ❑ information ® study session ❑ pending legislation AGENDA ITEM TITLE: Proposed Code Text Amendment to SVMC 19.65.130, CTA-2023-0001 Orphaned Accessory Structures GOVERNING LEGISLATION: RCW 36.70A.106, SVMC 17.80.150 and SVMC 19.30.040. PREVIOUS COMMISSION ACTION: None BACKGROUND: Pursuant to SVMC 19.60.030 B. Accessory Uses are allowed when they are subordinate to, or incidental to, a permitted primary use on the same lot. This means that an accessory use, by definition, is not allowed without a primary use. Generally, this limitation is not a concern; however, certain land use actions like boundary line adjustments and subdivisions result in an accessory use to be "orphaned" without a primary use. The City has developed a "work around" that allows the land use action to happen when the property owner desires to keep an orphaned accessory structure. The work around requires that the developer submit a building permit for a primary use on the lot with the accessory building just prior to recording the land use action. Once the action is recorded the developer has six weeks to begin construction of the primary use. The work around is problematic, complicated, and requires coordination and follow-up over an extended period. This often results in code compliance issues. Most importantly, the work around is not codified. CTA-2023-0001 is a city -initiated code text amendment to revise SVMC 19.65.130 to include language that would allow the developer to retain an accessory structure on a lot without a primary use. Tonight, staff will share with the Planning Commission a couple options for discussion about orphaned accessory structures. RECOMMENDED ACTION OR MOTION: No action recommended at this time.
