NOTICE OF ORDINANCE PASSED
BY SPOKANE VALLEY CITY COUNCIL
The following is the title and summary of Ordinance No. 04-043 passed by the City of Spokane Valley
City Council on the 26`h day of October, 2004.
AN ORDINANCE OF THE CITY OF SPOKANE VALLEY, WASHINGTON, PROVIDING
FOR THE VACATION OF A PORTION OF DAVID ROAD LOCATED BETWEEN
SPRAGUE AVENUE AND APPLEWAY BOULEVARD, WEST OF THIERMAN AND
PROVIDING FOR OTHER MATTERS PROPERLY RELATING THERETO.
The introductory paragraphs state that a hearing on this matter was held August 26, 2004, before the
Planning Commission, and the Commission determined that the change of use or vacation will serve the
public interest.
Section 1 makes certain Findings of Fact.
Section 2 vacates the street or alley described on the attached Exhibit A
Section 3 states that the zoning designation for the vacated property shall be the designation attached to
the adjoining properties.
Section 4 states the conditions of vacation and that those conditions shall be fully satisfied prior to the
transfer of title by the City.
Section 5 stipulates that following satisfaction of the above conditions, the City Clerk shall record a
certified copy of this Ordinance with the County Auditor.
Section 6 provides for a severability clause.
Section 7 states this Ordinance shall be in full force and effect five (5) days after publication of the
Ordinance Summary.
