BY SPOKANE VALLEY CITY COUNCIL
The following is the title and summary of Ordinance No. 05-010 passed by the City of Spokane Valley
City Council on the 8th day of March, 2005.
AN ORDINANCE OF THE CITY OF SPOKANE VALLEY, SPOKANE COUNTY,
WASHINGTON, ADOPTING CONDITIONS FOR AUTHORIZING ASSESSMENT
REIMBURSEMENT AGREEMENTS PURSUANT TO RCW 35.72 FOR THE CITY OF
SPOKANE VALLEY.
The introductory paragraphs state that the Growth Management Act requires communities to ensure that
infrastructure needs are provided concurrent with new development.
Section 1 states the intent is to establish a mechanism for public or private entities which participate
financially in providing needed infrastructure improvements, to receive reimbursement from other
benefiting properties.
Section 2 creates a new chapter in the Spokane Valley Municipal Code which provides for Assessment
Reimbursement Agreements.
Section 3 provides for a severability clause.
Section 4 states that the provisions shall be in addition to and not a substitute for or limited by any other
applicable laws.
Section 5 states this Ordinance shall be in full force and effect five (5) days after publication of the
Ordinance Summary.
