NOTICE OF ORDINANCE PASSED
BY SPOKANE VALLEY CITY COUNCIL
The following is the title and summary of Ordinance No. 06-012 passed by the City of Spokane Valley
City Council on the 9th day of May, 2006:
AN ORDINANCE OF THE CITY OF SPOKANE VALLEY, SPOKANE COUNTY,
WASHINGTON,AMENDING THE ZONING CODE REGULATIONS TO DEFINE "OFF-
ROAD VEHICLE USE," AND AMENDING THE USE MATRIX TO PRECLUDE SUCH
USE IN RESIDENTIAL ZONES; PROVIDING FOR SEVERABILITY AND EFFECTIVE
DATE.
Section 1: states the purpose and intent of this ordinance is to amend the Spokane Valley Municipal Code
(SVMC) 10.30.060 to provide a definition for off-road vehicle use; and to list which zones such off-road
vehicle use will be prohibited.
Section 2: amends SVMC to add the definition for "off-road vehicle use" as the operation of any gas-
powered motorized vehicle by which persons may be transported, including but not limited to
motorcycles and/or all-terrain vehicles, on private property for recreational purposes; and states that the
definition is not intended to include vehicles which were designed/constructed for yard or garden work in
residential areas; and further lists which zones prohibit the off-road vehicle use.
Section 3: explains that these provisions will prohibit new or expanded off-road vehicle use on the
effective date of this ordinance; and that any existing off-road vehicle use shall be abated no later than six
months following the effective date of this ordinance.
Section 4: states that the remaining provisions of SVMC 10.30.060 are unchanged by this amendment.
Section 5: provides for a severability clause.
Section 6: states this Ordinance shall be in full force and effect five (5) days after publication of the
Ordinance Summary.
