Sprague Spokane Valley, WA 99206 (509)921-1000 NOTICE OF ORDINANCE PASSED BY SPOKANE VALLEY CITY COUNCIL The following is the title and summary of Ordinance No. 09-007 passed by the Spokane Valley City Council on the 14th day of April, 2009. AN ORDINANCE OF THE CITY OF SPOKANE VALLEY, SPOKANE COUNTY, WASHINGTON, PROVIDING FOR THE ACQUISITION BY EMINENT DOMAIN OF CERTAIN LANDS NECESSARY TO BE ACQUIRED FOR PUBLIC PURPOSES IN CONNECTION WITH THE HAVANA STREET BRIDGE PROJECT, LOCATED IN THE CITY OF SPOKANE VALLEY, COUNTY OF SPOKANE, STATE OF WASHINGTON. Section 1 explains that public use and necessity requires the City of Spokane Valley to acquire the land, property, and interests therein as described in the attached exhibits. Section 2 explains that subject to the terms and conditions of the Interlocal Agreement, which is also attached to the ordinance as an exhibit, that the City Attorney and duly appointed Special Counsel are authorized and directed to commence an action to take by eminent domain, the lands and property necessary for the purposes set forth therein. Section 3 designates the Office of the City Attorney for the City of Spokane as special counsel to provide all legal services in conjunction with the Office of the City Attorney to represent the joint interests of the City of Spokane Valley and the City of Spokane as expressed in this ordinance. Section 4 explains that compensation for the land shall be solely payable by the City of Spokane as indicated in the ordinance.
