The following is the title and summary of Ordinance No. 09-023 passed by the Spokane Valley City
Council on the 22nd day of September 2009:
AN ORDINANCE OF THE CITY OF SPOKANE VALLEY, SPOKANE COUNTY, WASHINGTON
AMENDING ORDINANCE 07-015 SPOKANE VALLEY MUNICIPAL CODE SECTIONS 18.20,
18.20.020, AND APPENDIX B AND ADDING NEW SECTIONS 18.20.030, 040, 050, AND 060,
CONCERNING THE HEARING EXAMINER APPOINTMENT, POWERS AND DUTIES,
REMOVAL, EX PARTE COMMUNICATIONS AND CONFLICTS OF INTEREST AND THE
HEARING EXAMINER SCHEDULING RULES AND RULES OF CONDUCT.
The ordinance explains that a hearing was held before the Planning Commission, which forwarded their
recommendations to Council on the proposed changes and rules of procedure to be adopted. The
ordinance includes amendments to explain that the Hearing Examiner is appointed by the City Manager;
the powers and duties are fully explained in the new 18.20 section, including process and procedure for
removal, ex-parte communications, and conflict of interest; and Appendix B amends the rules of Conduct
concerning hearings,notice of hearings, staff reports, site inspections,presentation of evidence, reopening
or continuing hearings, dismissal of applications, recording the hearing, decision, reconsideration, and
clerical errors.
