If customers are currently enjoying a promotion, their rate will remain in effect until the promotion's scheduled expiration date. Please see the enclosed price list that identifies the rate adjustments and lists rates for service and equipment. Customers will be notified of these adjustments by mailers, cable bill notices, and legal ads placed in local newspapers. Comcast is providing customers unprecedented choice with bundled video, voiEe and high-speed Internet services that offer cost-savings and the convenience of one provider. We've more than doubled the amount of viewing choices for customers who now have the most HDTV and VOD viewing options with 100 hours of HD ON DEMAND and nearly 7,000 video on demand titles each month. Comcast has not charged any monthly fee to customers who require only one Cab1eCARD for television sets and other customer-owned equipment since introducing Cab1eCARDs in 2004. This move is a direct result of our focus on improving customers' experiences by listening to customer feedback on the appeaxance and readability of our bills, and responding to their needs. The new format will be enlarged and the font updated. Icons will be added for each service, and special offers and service information will be highlighted. The new statements will also clearly direct customers to our call center phone number, or Comcast.com if they wish to go online to review account status, order new service or handle bill payment. We have planned to issue a Request for Proposals for the cable franchise on May 5, 2006. This allows for a year to negotiate within the current timeline. While this date is not set in stone, it is a reasonable expectation within the framework of the cable franchise renewal process. In order to meet this deadline we will have to decide very soon as to what our definite course of action will be. There are various potential components of the ascertainment phase and the community needs assessment. Review of Ezisting Franchise Price: $2,500 A review of the current franchise allows the city to determine if the cable provider has met the terms of the existing franchise. Spokane Valley adopted the Spokane County franchise agreement with Comcast and it is very simple. Typically a franchise review will examine negotiated terms related to public, educational and governmental access (PEG), institutional networks, public access, production facilities and equipment, and system improvements. Franchise Fee Review Price: $4,500 A franchise desk review involves accountants reviewing the records Comcast has provided the City as supporting documenta.tion for the franchise fees. The review consists of analyzing documents supplied by Comcast and deternuning if Comcast calculates franchise fees according to the definition of gross revenues as defined in the franchise agreement or municipal code. No accounting source documents are reviewed and the report does not qua.lify as a review or audit conducted under generally accepted accounting principles. . Within the franchise fee desk review conducted for the City of Spokane, the consultant disagreed with the Comcast's exclusion of affiliate sales revenue, production revenue, and other revenue and believed that the Comcast owed Spokane $41,697 in franchise fees for the years 2001 and 2002. The consultant also believes that advertising revenue and shopping channel commission revenue r `City of Spokane Valley 2003 Settle and Adjust July 19, 2004 Page 2 of 5 were understa.ted by Comcast and bad debt was overstated. Comcast disputes these findings and has not agreed to pay this amount to Spokane. We performed an analytical review of franchise fees Spokane Valley has received in comparison to Spokane franchise fees. Table 1(below) illustrates that although the market saturation rate is lower in Spokane Valley, the fee revenue per subscriber is higher even in light of the fact that Spokane requires grossing up of revenue by applying fess on fees. The franchise fee revenue for Spokane Valley appears to be reasonable. - Table 1. This results in rates higher than 5% for subscribers. Any additional recovered fees will be passed on to subscribers. Technical Revievv of Systeffi Price: $13,550 A technical review of the cable system consists of three different components m Comprehensive Physical Plant Inspection This inspection reviews the Comcast physical plant system within Spokane Valley and tests it for compliance with applicable local and state electrical safety codes. • FCC Proof of Performance Report Review Twice each year (usually during January or February, and again in July or August) the FCC requires every cable system with 1,000 or more subscribers to conduct comprehensive technical inspections. These inspections comprise what are called "Proof-of-Performance" tests. The proof-of-performance report, produced by the cable operator based on the tests it conducts, contains the technical data that shows whether the local cable operator is meeting its federal picture and sound quality obligations. ~ ` City of Spokane Valley 2003 Settle and Adjust July 19, 2004 Page 3 of 5 . The federal purpose of the testing is to determine whether a particular cable system complies with the technical standards (47 CFR §76.605) established by the FCC, and to officially document the cable system's compliance (or non-compliance) with those rules. The FCC rules also require the cable operator to disclose how it conducted the tests, the equipment used, calibration data., and qualification data of those persons involved in the testing. The FCC requires that the Proof-of-Performance test results be kept in the cable operator's local business office for a minimum period of 5 years, and that the test report be made available for inspection by the local franchisor (47 CFR §76.1704). • Signal Quality Evaluation Cable television systems use many of the same frequencies within their cables as a multitude of licensed over-the-air users. These over-the-air users include TV and radio stations, police and fire safety services, and aeronautical radio services, among others. Cable operators are considered the secondary users of these frequencies; therefore they must not interfere with the licensed over-the-air users who are the protected (primary) users of these frequencies. The FCC has set maximum individual signal leakage levels for cable systems. As a further measure, the FCC requires cable operators to have a periodic on-going program to inspect, locate and repair leaks on their systems. In light of the potential for catastrophic harm that may be caused by a cable system interfering with aeronautical navigational and communications radio systems, the Commission requires more stringent regulations for cable systems that use aeronautical frequencies. Subsca-iber Sua-vey Price: $8,500 - $10,000 The survey will be a random telephone survey of 400 Spokane Valley citizens with a 95% confidence level and a margin of error of 4.9%. The survey assesses past performance of the cable operator, evaluates the quality of existing service, and identifies the future cable-related needs of the City. Residents who do not subscribe or no longer subscribe are also surveyed to determine if community needs have been met by the cable provider. • ° City of Spokane Valley 2003 Settle and Adjust July 19, 2004 Page 4 of 5 Other Coffiponents , There are other items important to the franchising process that can be performed internally. Focus Groups Focus groups are normally comprised of specific segments of the community that have a vital need for and can receive a direct benefit from the services and technology the cable operator can provide. Examples are the medical industry, schools and universities, govemments, and the business community. Institutional networks can provide a resource for training, education, and communication. Government.channels can be useful for information dissemination and accounta.bility to the public. Technology upgrades can be important for economic development and maintaining existing businesses. Public Hearings Public hearings are not required but they serve an important purpose by creating a record of the cable operator's compliance with the current franchise agreement, documenting the community's evaluation of the quality of service that the cable operator has provided, and learning directly from the public what the cable-related needs of the community are. Federal law requires that the public be given appropriate notice and a chance to participate in the fact-finding process. A public hearing is the ideal vehicle for that purpose.
