KNOW ALL MEN BY THESE PRESENTS, that the Grantor(s) Cottages on the Green LLC, for and in
f. consideration of mutual benefits, the receipt of which is hereby acknowledged, warrants and conveys to
the City of Spokane Valley, a municipal corporation of State of Washington, a RIGHT OF WAY DEED
c1, over the following described real property, situated in the City of Spokane Valley; Spokane County, State
of Washington, to -wit:

The City of Spokane Valley, as a part of the consideration hereof, does hereby agree as a
covenant running with the land that in the event facilities are constructed, maintained, or
otherwise operated on the property described in this Right of Way Deed for a purpose for which
a U.S. Department of Transportation activity, facility, or program is extended or for another
purpose involving the provision of similar services or benefits, the City of Spokane Valley will
maintain and operate such facilities and services in compliance with all requirements imposed by
all current laws, rules and regulations such that no person on the grounds of race, color, or
national origin, will be excluded from participation in, denied the benefits of, or be otherwise
subjected to discrimination in the use of said facilities.
TO HAVE AND TO HOLD the same, unto the said City of Spokane Valley for the purposes of a public
road forever.

All that certain real property situate in the Southwest One -Quarter of the Northeast One -Quarter of
Section 18, Township 25 North, Range 45 East, Willamette Meridian, City of Spokane Valley, County of
Spokane, State of Washington, being a portion of Lot 2 of that certain Short Plat SHP-25-05 recorded in
Volume 20 of Short Plats, Pages 85 & 86, records of Spokane County, Washington, and more particularly
described as follows:
COMMENCING at the southeasterly corner of said Lot 2 and the westerly Right -of -Way of Greenacres
Road, a found #5 rebar with plastic cap marked "KITZAN LS 33141";
Thence North 00°02'12" East along the East line of said Lot 2 and said westerly Right -of -Way a distance
of 11.25 feet to the TRUE POINT OF BEGINNING;
Thence leaving said westerly Right -of -Way along a tangent curve to the left with a radius of 28.00 feet
