TITLE NOTICE
1. Grantor, Big Sky Homes & Development, L.L.C., a Washington limited
liability company, is the current owner of the real property described as follows:
Lots 1, 2, 3, 4, & 5 Final Short Plat Rees Lane SHP 2022-0024, as per Plat
recorded in Volume 38 of Short Plats, Pages 83-84, records of Spokane County,
Washington.
Situated in the City of Spokane Valley, Spokane, County Washington.
Spokane County Tax Parcel Numbers: 45233.6001, 45233.6002, 45233.6003,
45233.6004, &45233.6005
2. Grantor is constructing a Primary Dwelling Unit and Accessory Dwelling
Unit ("ADU") on each of the five lots described in paragraph 1 above.
3. The City of Spokane Valley currently has land use regulations in place
imposing special development and use conditions that apply with respect to the five lots
described in paragraph 1 above.
4. Specifically, as set forth in Spokane Valley Municipal Code 19.40.030, the
title owner shall occupy either the primary dwelling unit or the ADU as their permanent
residence for six months or more of the calendar year and at no time receive rent for the
owner-occupied unit.
5. Additionally, as set forth in Spokane Valley Municipal Code 19.40.030,
home businesses are prohibited in the ADU.
6. At all times that City of Spokane Valley Municipal Code 19.40.030 or any
amendments thereto are in effect, the Grantor and its successors in interest shall comply
with the provisions of the Municipal Code pertaining to owner occupancy, receiving rent,
and operations of business on the property affected by this Title Notice described in
paragraph 1.
7. File No. ADU-2023-0005, ADU-2023-0006, ADU-2023-0009, ADU-2023-
0010, and ADU-2023-0011 are available for inspection and copying in the City of
Spokane Valley Community & Public Works, Planning Division.
8. Grantor, acknowledges and agrees that provisions of this Title Notice
shall run with the property and shall be binding on the successors and assigns of the
owners of Lots 1, 2, 3, 4, and 5 described in paragraph 1.
Release of this Title Notice can only be accomplished through the authority of the City of
Spokane Valley Department of Community & Public Works, Planning Division, or its
successor by recording a "Title Notice Extinguishment" based upon a finding that such
release should occur.
