The purpose of the meeting is to consider the items listed below on the Agenda. NOTE: Members of the public may attend Spokane Valley Planning Commission meetings in -person at CenterPlace at the address provided above, or via Zoom at the link below. Members of the public will be allowed to comment in - person or via Zoom as described below: Public comments will only be accepted for those items noted on fire agenda as "public comment" or "public hearinr." ADJOURNMENT Meeting Minutes Spokane Valley Planning Commission Centerplace Regional Event Center November 9, 2023 I. Planning Commission Chairman Granrath called the meeting to order at 6:00 p.m. The meeting was held in person and via ZOOM meetings. H. The Commissioners and staff stood for the Pledge Of Allegiance. III. Administrative Assistant Marianne Lemons took attendance, and the following members and staff were present: Susan Delucchi Val Dimitrov Karl Granrath Walt Haneke Bob McKinley, absent Nancy Miller Dan Wilson Tony Beattie, Senior Deputy City Attorney Chaz Bates, Planning Manager Nikki Cole, IT Specialist Justan Kinsel, IT Specialist Marianne Lemons, Administrative Assistant There was consensus from the Commission to excuse Commissioner McKinley from the meeting. IV. AGENDA: Chairman Haneke moved, and it was seconded to approve the meeting agenda for November 9, 2023 as submitted. There was no discussion. The vote on the motion was six in favor, zero against, and the motion passed. V. MINUTES: Commissioner Haneke moved, and it was seconded, to approve the October 26, 2023, minutes as presented. There was no discussion. The vote on the motion was six in favor, zero against, and the motion passed. VI. COMMISSION REPORTS: There were no Planning Commission reports. VH. ADMINISTRATIVE REPORT: Planning Manager Chaz Bates stated that the second Planning Commission meeting in November will be cancelled due to the Thanksgiving holiday. He also mentioned that Commissioner Haneke and Miller's position appointments end on December 31, 2023 and applications will be accepted for the vacancies until December 22, 2023. VIII. PUBLIC COMMENT: There was no public comment offered. IX. COMMISSION BUSINESS: 11-9-2023 Planning Commission Minutes Page 2 of 3 a. Findings of Fact: Clearview Triangle Regulations Update The public hearing was opened at 6:12 p.m. Planning Manager Chaz Bates provided a brief overview of the Findings of Fact for CTA-2023- 0003, explaining how they formalize the Commission's recommendations made after receiving public comment during the public hearing and Planning Commission deliberations. Commissioner Miller moved, and it was seconded to approve the Findings of Fact for CTA-2023- 0003 as submitted. There was no discussion. The vote on the motion was six in favor, zero against, and the motion passed. b. Public Hearing: CTA-2023-0004 — Planning Commission Meeting The public hearing started at 6:06 p.m. City Attorney Tony Beattie presented a staff report. He stated that CTA-2023-0004 is a city - initiated code text amendment to revise SVMC 18.10.030 to provide flexibility in the number of Planning Commission meetings. Currently, SVMC 18.10.030 requires the Planning Commission to meet at least once every month. This code text amendment provides flexibility when there is no business for the Planning Commission to conduct. The proposed code text amendment would require the Planning Commission to hold at least one regular meeting each month not less than nine months in each year. This is consistent with other state laws related to Planning Commissions. Mr. Beattie said that this code text amendment does not modify the regular meeting schedule of the Planning Commission. The Planning Commission will still have regular meetings scheduled at 6:00 p.m. every 2nd and 4th Thursday of each month. Mr. Beattie mentioned that if this amendment is approved, there will be a need to update the Planning Commission Rules and Procedures to reflect the change. This will be included in a comprehensive update during 2024. There was no public comment offered. The public hearing ended at 6:25 p.m. Commissioner Haneke moved and it was seconded to approve CTA-2023-0004 as submitted with an amendment stating that there will not be two consecutive months without a meeting. There was no discussion. The vote on the motion was six in favor, zero against, and the motion passed. X. GOOD OF THE ORDER: Chairman Granrath ratified cancelling the second meeting of November due to the Thanksgiving holiday. Commissioner Delucchi requested that the Chair acknowledge the outgoing members of the Planning Commission for their years of service at the last meeting of the year. XI. ADJOURNMENT: Commissioner Haneke moved, and it was seconded, to adjourn the meeting at 6:40 p. m. Currently, SVMC 18.10.030 requires the planning commission to meet at least one time every month. This code text amendment provides flexibility when there is no business for the planning commission to conduct. The proposed code text amendment would require the planning commission to hold at least one regular meeting each month not less than nine months in each year. This is consistent with other state laws related to planning commissions, particularly RCW 35.63.040 which has the same requirement. Pursuant to RCW 35A.63.140, which applies to code cities, "[a]ny duties and responsibilities which by other statutes are imposed upon a planning commission may, in a code city, be performed by a planning agency, as provided in this chapter." This code text amendment does not modify the regular meeting schedule of the planning commission. The planning commission will still have regular meetings scheduled at 6:00pm every 2nd and 41 Thursday of each month. The proposal will not have an impact on the planning commissions responsibilities and duties under chapter 18.10 SVMC. On October 12, 2023, the Planning Commission conducted a study session; on November 91' the Planning Commission conducted a public hearing followed by deliberations. During deliberations the Planning Commission discussed a desire that the increase in flexibility would not result in the Planning Commission going longer than two consecutive months without holding a meeting. A motion was made to amend the draft language to that effect. The Planning Commission voted 7-0 to recommend that City Council approve CTA-2023-0004 as amended by the Planning Commission. The planning commission shall every year organize and elect from its members a chair, who shall preside at all meetings of the planning commission and perform such other functions as determined by rule. A vice chair shall be elected to preside in the absence of the chair. A majority of the planning commission members shall constitute a quorum for the transaction of business, and a majority vote of those present shall be necessary to carry any proposition. B. The planning commission shall determine a regular meeting schedule (time, place and frequency) and shall meet -hold at least one regular meeting time @*efy each month not less than nine months in each year, provided that there are never two consecutive months without a meeting. All meetings shall be open to the public. C. The planning commission shall adopt such rules and procedures as are necessary for the conduct of business, subject to the approval of city council, and shall keep a recording of its proceedings. D. All hearings before the planning commission shall be conducted in the manner set forth in Appendix B. FINDINGS AND RECOMMENDATIONS OF THE SPOKANE VALLEY PLANNING COMMISSION CTA-2023-0004 Proposed Amendment to Spokane Valley Municipal Code (SVMC) Pursuant to SVMC 17.80.150(E) the Planning Commission shall consider the proposal and shall prepare and forward a recommendation to the City Council following the public hearing. The following findings are consistent with the Planning Commission recommendation. Background: 1. Pursuant to RCW 36.70A.130, Spokane Valley adopted its 2016 Comprehensive Plan Update and updated development regulations on December 13, 2016. 2. CTA-2023-0004 is a city -initiated text amendment to revise SVMC 18.10.030 to provide flexibility in the number of planning commission meetings. 3. The Planning Commission held a properly noticed public hearing and conducted deliberations on November 9, 2023. 4. During deliberations the Planning Commission discussed a desire that the flexibility would not result in the Planning Commission going longer than two consecutive months without holding a meeting. 5. The Commissioners voted 7-0 to recommend that the City Council approve the CTA-2023-0004 with the amendment to ensure that the Planning Commission would not go longer than two consecutive months without a meeting. Planning Commission Findings: 1. Compliance with SVMC 17.80.150(F) Approval Criteria a. The proposed text amendment is consistent with the applicable provisions of the Comprehensive Plan. Findings: The Comprehensive Plan does not identify specific goals and policies relevant to the Planning Commission procedures but identifies specific goals and policies to be considered in the development of the comprehensive plan and development regulations. A review of the goals and policies did not identify anything inconsistent with the proposed CTA. The proposed amendment is consistent with the Comprehensive Plan as the amendment establishes the minimum number of meetings required for the Planning Commission to conduct its business as it relates to Comprehensive Plan amendments and other matters such as code text amendments. h. The proposed amendment does bear a substantial relation to public health, safety, welfare, and protection of the environment. Findings: The proposed amendment bears substantial relation to public health, safety, welfare, and protection of the environment. Conclusion: The proposed text amendment is consistent with the Comprehensive Plan and bears a substantial relation to public health, safety, welfare, and protection of the environment. 3. Planning Commission Recommendation: The Spokane Valley Planning Commission therefore recommends that the City Council approve CTA-2023-0004 as amended by the Planning Commission.
